It doesn't say if he merely provided the materials for artificial insemination or went about it the old fashioned way but either way, the situation sounds a bit skeevy. On the other hand, if this stands up, it could set a dangerous precedent. |

.....the state is coming after him for child support as he dealt with them directly instead of going thru a doctor's office for the procedure. I knew I missed something when I first heard about this over the weekend. I was beginning to think *any* sperm donors would soon be liable for child support, and the reports certainly made it sound that way. (Of course, I fully expect that to someday happen, mind you.) |

The take-away is that if you use informal procedures for donating sperm, you may be hit up for child support. You are, after all, the biological father, and decided to ignore the laws protecting you from liability if you had done this the right way.
Private parties aren't allowed to decide child support arrangements on there own. That always comes down to the best interest of the child, agreements of the parents be damned.

The state is the one that wants him to pay not the women. That is the thing. The kid has two parents that are willing and able to cover everything. They don't need or want the bio-dad paying. There was nothing shady here, it was just a traditional handshake deal, just not your usual handshake matter. The state will take money out of the guy's check and the mom(s) will just send him a check back. Should the guy have covered his ass better? Of course he should have. But being that both parties were on the level with each other and we aren't talking about any ill-gotten goods don't see how this can be called a shady deal. |
