I think it's a matter of intent. DWIs and DUIs are worse crimes for sure (and I would have released all of them) but they are lapses of reason made obviously while not in the proper state of mind. They're crimes of stupidity. Shoplifting is a crime of dishonesty.
Given the choice I'd rather employ neither but, if I had to employ one, I'd choose the stupid asshole rather than the lying asshole any day.

I would say one is not necessarily a dishonest choice some people have like a noncompulsary disorder. Like the rich women who can clearly afford the item shoplifting from boutiques. DUI's are people literally playing Russian Roulette with others lives. Imo it's a serious problem that WWE/MLB shamefully looks that other way at when it's almost a commonplace part of their sports culture.

I'd like to see a statistic on how many iPhone case shoplifting-related fatalities there's been in the past year. Life doesn't work based on theoretical scenarios. Swagger didn't kill anybody. Riley didn't kill anybody. Etcetera. I'm in Toronto so my mayor is the famous Rob Ford. The guy smoked crack multiple times, was drunk driving and he's a full on racist and homophobe. He is still the mayor of Toronto. I don't support it and I hate the mayor but substance abuse vs theft is just very different, period. I think the biggest difference between the two is that nobody, to the best of my knowledge, has ever killed innocent people from shoplifting an iPhone case. Again, I may be wrong. Let's check the statistics and go to our leaderboard, Moe!

Larceny is, by definition, a crime of dishonesty. Arguing that DUIs are worse doesn't change that fact.

For the DUI vs. theft debate,companies will almost always go harder on the theft because the DUI doesn't affect them unless the person is a) coming to work drunk or b) can't get to work because of having their license suspended etc. whereas if someone is caught shoplifting their employer is going to ask themselves "if they're brazen enough to steal from WalMart, what are they taking from us/our other employees when no one is paying attention?" That is the main difference. There's no denying that driving drunk is more dangerous and worse overall, but I can guarantee that this is how companies view it.

It's to the point here that applications for jobs where company property is in your care specifically ask "have you committed any crimes involving dishonesty". In the big picture company-wise you stealing from them would affect them more than you driving drunk through a pre-school playground during recess on "take your kittens and puppies to school" day. This is for jobs where you don't represent the company as a whole on your off-time though... a job like WWE is entirely different where the company markets themselves off of your image. They absolutely should have fired all of the Florida F**k-ups. The difference is, thanks to capitalism, they would have an easier time finding new jobs than Emma.
