I hate making threads about personal problems. I don't mean to offend the people that regularly do, but I'm just not a fan of putting my personal life out there like this. But I'm having a problem with my apartment and I could use any advise I can get.
Basically I've lived in a third floor studio apartment in New York City for about seven years now. For about the last four years I've been using a window mounted 8000 BTU Air Conditioner for it. It's small, unintrusive, easy to install and is suitable for an apartment my size. Yesterday I was contacted by my buildings super who told me I needed to remove it. Apparently it's too small and unintrusive. There's a small ledge, maybe 4 inches long, outside my window, and instead of the water dripping straight down onto the ground, it's instead dripping onto the ledge then drizzling down the side of the building, apparently getting into the walls of the apartment below me causing water damage there.
My super is basically placing all the blame on me, and telling me I'm going to be responsible for paying off the repairs for the water damage. He's also telling me I should've bought a larger unit to avoid this and had him install it. This seems ridiculous to me as my apartment is no where near big enough to need a larger AC and getting him to install my AC seems silly. It's like asking him to install my new DVD Player. They're also probably not gonna offer to renew my lease in the Fall.
I personally think it's ridiculous that I'm being held solely responsible for this. When I moved in at no point was I ever told by anyone that there were any restrictions to the kind of Air Conditioner I could use or that I needed the Super to install it. While I haven't been able to find my overlease, I have checked my sublease and Air Conditioners are not mentioned anywhere. I had no way of knowing about the dripping water or that it was causing problems for other apartments. I also don't understand why it took them four years to even mention anything to me about it.
While I have places to go if I do get thrown out and I was looking to move anyways (I wanted a place closer to my job), I hate having things end like this because I'm afraid it might hurt my chances at getting apartments in the future. Does anybody have any advise for me about this? Legal or otherwise?
