HIS mental anguish? Shouldn't he sue his wife for stupidity if his anguish is at stake? And loss of consortium and sexual relations? She could have put out with her leg in a brace. Or they could have been creative. Wouldn't Excersizing due caution mean NOT STANDING ON RR TRACKS!!! I mean who doesn't realize big huge trains that are tough to stop can come barreling down the tracks at anytime.

Did anyone notice it was a cable hanging from the train that hurt her 6 feet from the tracks? This is actually a good case that could go either way.

BNSF says that they have ways of knowing if stuff like that happens. and still, even if it was a cable, she was within close enough proximity (6ft) that a rock or other object shot off the track by a wheel could have likewise done major damage. in civil court, responsibility can be meted out on both parties. so a judge or jury could say the RR is 10% at fault for having faulty equipment, but the woman is 90% at fault for being an idiot.

Of course. However, just because she trespassed doesn't mean she's enough at fault to lose. All I meant was that normally on this board when there's lawsuits posted people knee-jerk say the "victim" is somehow wrong or that the person is clearly guilty. The facts here though are definitely sketchy and need to be sorted out in court, along with just how liable each party is. This reads more like a law school exam type scenario rather than a cut and dry "they're stupid" case.

Wow. That's gotta be the most shallow reason ever. "You don't get it! My wife has one leg! Do you really expect me to tap that now?!" Loss of Consortium gets thrown out all the time. Hell, my sister was in a car accident and she was sued by people in a third car who sustained minor injuries and their spouses/boyfriend sued for it. It's so ridiculous, but luckily most courts don't buy it too often.

If you need a sign to be able to distinguish that train tracks are dangerous to stand on, then really... you deserve to get hit by a locomotive.

That's not my fault!" That made me think of the movie Just Friends. It reminded me of the scene where Anna Farris sticks aluminum foil into the microwave, and sets the plane on fire. When they arrive on the ground, she says "How was I supposed to know that you don't put aluminum foil in a microwave." Best lawsuit I ever heard of involves a woman in California. Her husband would go to the gym every day and work out. One day, he was in the showers at the gym when he slipped, fell, and broke his leg. He had to rest at home for months, during which time he met a woman online and ended up leaving his wife.
So what did the wife do? She sued the gym because had they offered a safer shower environment, her hubby would have never gotten hurt and ended up cheating on her.
