In both cases, I think it's more a case of WWE protecting not the name itself, but the characters they portray in the ring. If Cena or Orton went to TNA, of course they could wrestle under those names. WWE could definitely stop TNA from issuing Cena merchandise with "You Can't See Me" on it, or referring to Orton as the "Legend Killer."

During the Trial of Eric Bischoff, Coach called Masters (who was also the bailiff) as a witness. He was sworn in, then Foley asked for his name - he said Chris Masters, and that lead to Vince ordering Masters to remove himself from the court room for lying under oath.

Yeah that Masters thing was strange, I remember being slightly shocked when Vince said his real name on air.
I think JR called Xpac by his real name during an interview once. ECW would use real names alot as well (like the Taz comeback segment).

However, real names used as character names can be copyrighted, so if Cena were to jump to TNA, he'd have to use a different name for his character. You sure? Just saying every guy who's went to TNA with his real name kept it. Even Christian skirted it by adding Cage back on. He could always be Jon Seena I wouldn't worry Cena would just show up in TNA and they'd the announce team would just say, "Oh my god, what is The Marine doing in the Impact Zone?!!??!"

He could always be Jon Seena I wouldn't worry Cena would just show up in TNA and they'd the announce team would just say, "Oh my god, what is The Marine doing in the Impact Zone?!!??!" And of course the fans would cheer, say they always loved him, and that WWE has misused him all along and held him back.

It means they have the right to use and sell merchandise of that name. As far as I'm aware, it doesn't mean he couldn't use it if he left, it means TNA couldn't take, say, Nigel and name him "Jon Sena." It may have also been to try and keep his father (John Cena Sr.) from making money doing indie shows as a ref/manager/mouthpiece under the name "John Cena", trying to trick people into thinking it was his son.

They were trademarking names before Cena got big, though. I don't think they care as much about small indy shows as larger companies creating ripoff characters.
