Chris Jericho hits a female fan and everyone says "Wait till we have the facts, I'm sure there is an explanation" then after they find out what happens it gets justified Randy Orton allegedly spits gum and insults a fan and without any knowledge of the facts its a Guilty vote To be clear, I'm not condemning Jericho for that incident as I agree he was in a dodgy situation however you just know if this read Jericho instead of Orton that everyone would be saying "Well lets get the facts first" so I'll wait till the facts come out before condemning or justifying Ortons actions "Facts?", "Wait?", "EXPLANATION?" JUST WHAT THE HELL DO YOU THINK YOU'RE TRYING TO PULL HERE!?

Yeah, nothing to do wth wrestling or my preferences.
I saw Jericho's situation unfold. He was in a spot, may not have handled it the best, but even so, he isn't known for that kind of behavior.
Where as Randy has been known/rumored to do this stuff all the time. Hence why I don't quite need the facts.

And this does seem to fit in with Orton's pattern of behavior. Not a fan-friendly guy. Not a luggage-friendly guy either. Yes we eventually got a video but my point is that before the video came to light, the majority of that thread said "I'm sure theres an explanation, lets wait till we get the facts" And I don't think he should be found guilty because he squirted makeup cream or whatever it was into a ex-divas makeup bag Again, I'm not excusing Orton for his behaviour if the story as told is true, I'm just waiting for evidence

Not sure I believe all this. Even though I half like/half dislike Orton, I'm in the "let's wait for the facts" group. To an earlier poster, about Jericho's incident last year. Jericho did punch a fan, but said fans were getting violent first) Maybe the kid is a friend of Kofi's.

This is still considered assault, believe it or not. It sounds like there is more to the story, anyways. Kowloon's is kind of a regular spot for these guys and they were just in Boston recently for a house show, but the dates don't really match up.

This kid is such a chump.
If I got yelled at by a heel I'd be jazzed.
When I got to shows and the heels yell at me to shut up or try and intimidate me, I think its great. Its a fun part of the whole wrestling experience.
This kid (or his mom) sounds like the pathetic people who would sue MacD's over spilling coffee in their own lap.
If I went up to Orton and asked for an autograph and got shot down in a rude way I'd just yell something like, "you're a jerk Orton, that's why Sheamus is gonna destory you!"

I read and posted about this story elsewhere, but it still bugs me. What gets to me is that, yes, Orton is a douchebag but not a complete one. I met him last September at the airport and took his picture from afar. He noticed and heeled on me for it. Granted, he didn't go as far with me as spitting gum or calling names, but he did "confiscate" my phone for a moment. I went along with it because I honestly couldn't tell whether he was in character or if the stories about his prickishness were real. Still it turned out okay; I got my phone back and I got to meet/talk to Randy Orton.
Orton, by the way, stayed in the airport and took pictures with a lot of people. I just see it as he's particular about having his picture taken off-guard. In this case, I see the kid as some typically overeager 15-year old who likely would have laughed the situation off and had a cool story for his friends if it weren't for his mother, who I see as the one who took the situation too seriously. There are stories that go back for years about wrestlers being douchebags IRL to fans; this is just one story that ended badly.

To clear this up, as long as the magistrate does not bring criminal charges against Orton, this is what the kid could be entitled to in a civil action:
1) Assault - If he was aware of Randy spitting at him, i.e. he didn't have his back turned, then this is a case of an assault in tort law. He'd get at best nominal damages.
2) Battery - If the spit actually made contact with him, he'd get at best nominal damges.
3) Emotional distress - Most courts are very, very reluctant to give emotional distress damages if there is no physical injury. Since Orton acted with intent, there wouldn't be a possibility for negligent infliction of emotional distress charges. In order to recover for intentional infliction of emotional distress, they'd have to prove that Orton had 1) Intent 2) The conduct was extreme and outrageous 3) the person did suffer severe emotional distress, and in with this it must be what would cause a reasonable person to suffer severe emotional distress and 4) there must be causation. Basically, the point I'm trying to get to here is, it is very unlikely that the court would give any damages for emotional distress here, as this is a mere vulgarity, not something that would cause emotional distress for a reasonable person.
These things being said, the most Orton will pay is probably literally a few bucks in damages and if charged criminally a fine. Now let's look at the flip side of this, I personally think it is a small price to pay. Literally, it wouldn't shock me if Orton got out of this without paying a dime, but if he does, unless he gets a charge happy judge, the cost will be minimal. Now look at how much bigger of a heel he comes off as for those few bucks. That kid and his mom probably appeared on the local news, they're probably local damn celebrities now. Next time Randy Orton comes to town, people are gonna say yeah Big Show is just acting like a bad guy, but that Randy Orton, he's a mean bastard because he spit on a kid over an autograph. Classic.
