Tosh had a right to make the joke, but I'm not even remotely going to defend what he said to that woman.

I'm not sure if this was the initial "offending joke", but I've seen this one going around, so perhaps this is it:
If that's the joke, the key difference here is that this isn't a joke that maliciously seeks out rape victims to belittle their nightmarish experiences. Rather, it's an outlandish, obviously fake situation.
Also, he apparently followed up later with a joke about a mentally handicapped kid, and the crowd gave an "ooooh", so he said:
Honestly, that's pretty well done.
Again, if we tell comics, or any artists, that some subjects are simply off-limits, we're not doing ourselves any favors as a society. If a comic tries to handle sensitive subjects and just does it in an awful, ham-fisted, truly offensive way, you can basically rest assured that comic won't last too long in the industry, by and large.

I feel quite uncomfortable saying this, given the subject matter is rape, but the girl in the audience was asking for it.
Let me clarify, once more, that she was asking to be verbally run-down by the comedian on stage. That's what she was asking for. I cannot emphasize that point enough.

I don't think anyone is saying he can't say what he wants (he can of course), but you don't get to say whatever you want with impunity under the guise of 'hey, it's a joke'.
The ability to say what you want goes both ways.

That silly string joke was even in his comedy special. Not a fan of his response, but stand up comedy shows aren't the place for thin skinned people. Anyone familiar with Tosh's work should know that's Tosh being, well, Tosh. He's made a number of anti-rape jokes about Kobe and Big Ben. It's all a part of his act. f***, I'm Jewish and I've laughed at Holocaust jokes.

The ability to say what you want goes both ways. No, it really doesn't, not in the setting of a comedy club. Again, if you really don't like an act in a comedy club, just quietly get up and leave; hell, even go to the owner of the club and ask for a refund if you so desire. But pipe down during the act. If the comedian sucks, he/she won't be back any time soon. If you choose to pipe up, you've basically forfeited the chance to just sit back and enjoy the show as an audience member.

The ability to say what you want goes both ways. exactly. it's like I always say, you have the right to say whatever you want, but by the same token you have to accept that everyone else can tell you, then, exactly what they think about what you just said.

To paraphrase damn near every comedian ever, do they pay to see you do your job and then tell you that you're not doing it well enough...ect? No. Therefore... My all time favorite heckler handling comes from Drew Carey. He made an Elvis joke and someone booed. Drew:"Boo? Hey, f*** him, he's dead. What, is he gonna haunt me while I'm on stage. *as Elvis, complete with karate moves* 'Hey man..BOO!' Elvis is still alive, he was on the alien spaceship with me. It was me, Elvis and Bigfoot. They f***ed us, took a blood sample and let us go. Didn't you see the sign out front? Comedy show. Comedian. f***in' jokes!"

I also love how this is his witty banter to a heckler. This was the best he could do?
What a loser he is.

Again, though, that does not hold up in a comedy club setting. As a paying audience member you do not have an automatic right to stand up and interrupt the show. Clubs will often hang back when people heckle both for fear of having a bad scene break out (since booze is often involved) and also because they like when comedians silence hecklers, but its like going to a sporting event, if the club feels you've overstepped boundaries, you're gone. Once again, the best way to express displeasure with a comedian's act is to not laugh, get up and leave, demand a refund, and let the club owner know exactly how you feel. There's no justification for interrupting an act, just as there wouldn't be for interrupting a live theater show that deals with some sort of sensitive issue.

I can understand not liking rape jokes, and that's fine. But like it or not, that's Tosh's kind of humor. Who are you to tell him what's funny or not? If you don't like what he's saying, don't listen. Leave. But don't get up, interrupt his act, and try to tell him what he can or can't joke about. That's where she loses my sympathy.

I will give you that. she shouldn't have interrupted him like that. I do stand by what I said, though, in regards to people saying what Tosh said in defending himself was out of line. as stupid and insensitive as it was, he had a right to say "oh I hope this woman gets raped". and now, he has a right to listen to other people telling him that's a terrible thing to say, even if she did interrupt him.

I think some people are letting their disdain for Tosh cloud their judgement. It's his act, they paid to see him. They heckled him and caused a disturbance in his act, he should be able to respond however he wants. They didn't need to heckle him.
I can only imagine the hate filled rants that would fill a thread if it was Seth Macfarlane making the rape jokes.

Exactly what I figured the response would be. Allow me to clarify. If this thread was about Seth shutting a heckler down by using the exact same jokes, I imagine the hatred would be a cause for uncomfortably. Whether you like the comic or not, it should still be noted that it's their act. People go see them, not to see thin skinned people complain their act bothers them. I'm sure they (as in the entire audience, sans the complainer) knew going in what Tosh's humor was like and had zero problem with it. They are jokes, after all.

I'm fully behind Tosh in this situation. You try to make yourself a part of the act, and then you complain when it happens? Because that's essentially what this person was doing. Did she expect Daniel to stop his act and apologize to her, or not even acknowledge her?
And yes, rape jokes can be funny. Almost anything can be funny.
People should realize what they're in for when they go to a stand-up show by now.

Don't find it offensive, just terribly unfunny. Of course, that's not new territory for Daniel Tosh. He really is the 21st century Andrew Dice Clay, say stupid s*** to get a rise out of people and hope and pray somebody laughs in the process.

LANGUAGE LANGUAGE.
Someone referenced Norton's defense of Daniel Tosh. He lays it down pretty well.
