Now why couldn't they get McDevitt on the World Wildlife Fund case? They did. He lost. He's pretty vicious when it comes to cases involving disgruntled former employees, though, and is fond of using the tactic of dragging a case out until the opposition run out of funds. Nevertheless, Jesse Ventura and CM Punk's lawyers got one over on him. He's also gotten a couple of death penalties overturned in the last ten years. That's pretty impressive.

I'm all for preventing frivolous lawsuits, but...man, these guys may be actually suffering. And WWE's doing what it can to not have to pay out. Which I get, because it's going to prevent them from going out of business. I dunno, just another reason why I hate the legal system.

A three year statute of limitations for the long term consequences of injury caused by actions workers were pushed to take by the company is absolutely monstrous, the long term effects of being smacked with a chair and made to work through injury won't really be known until years after their employment has ended so if they won, it would block people with a genuine case from filing suit.
If this flies, it makes one wonder why the NFL or companies involved with asbestos and chemical leaks didn't just relocate their offices to Connecticut to avoid any of the long term consequences of their negligence because the 3 year rule is a mighty fine get out of jail free card if it can be used to kill suits in this way.

While I have absolutely no problem with WWE squashing the cash-grab lawsuits, I still don't like the idea of WWE not being responsible for concussions that former talent suffered while working there. I mean, they only started the IMPACT testing in, what, 2007? That's a crazy long time of head shots with chairs, dangerous moves, and reckless talent. I'm not saying WWE should just hand out money to everyone claiming they were hurt, but there should be some mutual accountability here. But you have to remember that 2006/2007 was when people really started learning how serious concussions and head injuries were. Before that it was the old "bell rung" mentality. People seem to forget that prior to Chris Nowinski's Sport's Legacy Institute and CTE studies people were pretty oblivious to the long term effects of head trauma. And if I'm not mistaken, WWE the "fake" sport started doing concussion testing before ANY other major North American sports league

Reading the details in the OP, I think I could win them this case, never mind McDevitt. Claiming multiple living plaintiffs are deceased? That's weak.
Though I think WWE will win this case, I bet the court won't even touch that 3 year statute of limitations that WWE keeps mentioning. I think the court can rule that WWE was not negligent because they didn't know about the long term effects of concussions many years ago (because no one did), but if they try to make some argument that any maltreated star of today has three years or less to bring forward a lawsuit about somelthing like CTE, for which symptoms can take decades to manifest, I think the court will rule against them.

I'm always skeptical about these concussion lawsuits even if the people filing them are genuinely ill. Same goes for the NFL. Anyone with common sense would know that taking blows to the head will cause problems. You are under no obligation to be a wrestler or an American football player. There is always the alternative option to simply remove yourself from a dangerous career and do something else. If you choose to pursue those careers, there are risks you must accept, even in the days before head trauma science was clearly understood.

Sure, but even outside the confines of this case, it's a well known fact that Jerry McDevitt is a f***ing shark. He is just a vicious litigator. Seems like a great place to make your name with these embarrassingly easy cases to litigate. I can't think of any cases where WWE was clearly at fault that he got them out of (the mark of a good lawyer). True, if you forget the 90s steroid scandal that almost destroyed the WWF and sent Vince to jail.

WWE shouldn't be allowed to say "Whoa, my bad" to older guys just because they recently found out concussions were dangerous. What would happen to current wrestlers if down the line, we found out that constant back bumps were dangerous? Would guys like Dolph Ziggler, Seth Rollins, and Roman Reigns not have claim to compensation or medical help just because WWE didn't know at the time? It's a slippery slope, imo.

on the one hand I think all this head rauma is a serious issue and WWE should be doing more to help guys who did suffer long-term brain damage from working for them. on the other hand, this guy is a total ambulance chaser and including Big Daddy V and stringing his widow along in this suit just seems vile.

Somebody posted Billy Jack Haynes Facebook posts about this a few months back. I know he mentioned some of these names getting in this suit getting involved, along with Sabu. If Sabu is a part of this case against WWE, they've already lost. Dude practically eats chairshots.
