As long as you're betting money on a possibility to make more money, it's gambling, and daily fantasy is no different from sports books, horse races, or poker in regards to that. The fact that people spend days plugging in variables doesn't mean there's suddenly less chance that a random event could tank your lineup. So really, the same rules should apply to all three.

It's basically identical to poker in terms of skill and chance involved. And it has a lot of similarities to betting on horse races. Yeah, there's skill involved. But it's still gambling because there's still a very present element of chance.
The entire thing with New York is basically saying "You want to do this? You gotta play by our rules." I don't think the state would have a problem with Daily Fantasy as long as there were certain regulations and safeguards to protect the betting pools.
