I'm in the camp that firmly believes he's being suspended for thumbing his nose at the NFL and destroying his cellphone. Nobody in the NFL gives a shit anymore if a football 2 years ago was missing 2PSI of air pressure.

I'm so tired of this deflategate thing. Look. I'm pretty sure that he cheated. But until the NFL is willing to overturn game results, playoff or Super Bowl included, which will NEVER HAPPEN, all of this is just theater. Fans don't care about cheating, the league doesn't care about cheating, the sponsors don't care about cheating. No one cares enough to actually overturn a game. So let's stop with this theater. I'm long past caring, as well. Some people are mentioning that the NFL should compromise and give Brady a reduced suspension, but this is the NFL we're talking about. There's no way in hell Goodell is going to back off from this because he's petty as shit. Plus, the only place that this can go is the Supreme Court.

Did Tom Brady actively have a role in all of this? Absolutely. It's probably irrefutable.
Should he have handed over his cell phone to NFL investigators? f*** no. That's his private property. I don't care if it's germane to the investigation, he has every right to maintain his privacy.
In short, using his refusal to cede personal effects as proof of guilt is some bullshit.

Taking off my Patriots fan hat for a second here, I have to say that today's ruling is *terrible* news for the NFLPA. Good luck getting any power back from Goodell. There is absolutely going to be a lockout/strike when this CBA is up over the issue of Goodells authority over discipline

Breaking: Court rules in favor of the NFL in the Deflate gate case. Brady to serve 4-game suspension. I guess the Patriots will be playing on wildcard weekend this season I'm not sure Id go that far just yet. Arizona on the road is going to suck, but the next 3 are at home against tough, but beatable teams. Quite possible the Patriots are 3-1 after week 4.

Listening to Steve Kallas on the radio, who is WFAN's legal guy, Brady and the NFLPA have two options.
1. Request that the entire membership of the 2nd Circuit (versus the 3 judge panel that heard the case) listen to the case, which is incredibly unusual and extremely unlikely. It's only done in extenuating circumstances and this is not one of them.
2. Throw a Hail Mary to the SCOTUS and hope against hope they decide to hear the case. This option is, believe it or not, more likely than #1, but still incredibly unlikely. The Supreme Court has a lot on its plate, especially since they're short at least one judge for the near future. I doubt it even gets this far, especially since it's something that doesn't ask a major Constitutional question or the potential to set important, far-reaching legal precedent.
If the rest of the 2nd Circuit and the SCOTUS decline to take up the case, the Appeals Court's ruling stands and that's that.

This is also one of the few times I can remember where the legal system ruled AGAINST the players in favor of the NFL. The NFLPA's recent strategy has seemed to be "make concessions in negotiations that are legally ridiculous and we can fight them in court and probably win" and that strategy backfired on them big time.

Yes, but his multi-million dollar contract that he signed indicated that ha conceded that privacy if the NFL has reason to investigate him. That's not to say that the NFL can just do whatever as long as it is written into the contract, but they do have a lot of leeway. They wanted his phone and texting history as it pertained to Patriots staff, which is something that they can (and did) ask for as per the terms of his contract. I agree that the reason he was punished was that he destroyed the cellphone. In all honesty, that probably was considered the more severe violation and his suspension was for all things Deflategate that he was involved with, with the destruction of evidence ruled the most damning violation. I suspect that had he simply turned over the phone he would have only gotten one game and a fine as punishment, but he could not do that since it would have definitively demonstrated he was a cheater and damaged his brand. As someone who makes so much on endorsements, he chose to avoid that. I don't actually fault him if that was his logic. I probably would have too, though I would not have put myself in that position to begin with. Unfortunately, by obfuscating the evidence like that he left open the door to plausible deniability, which many of his fans enthusiastically ran through and helped make this the circus it became (those of us who argued in favor of punishing him played a significant role in that as well).

Well, if it's written into the deal, it's a complete nonstarter, then. But I think you're right in that his chosen tact allows for (barely) plausible deniability which is less harmful to his brand.

If someone picks him up, he is the luckiest QB ever, financially. Last rookie to get in the elevated rookie scale and got a pretty good contract last month. If I ever meet him, I will give him a hundred bucks to buy some lottery quick picks to share 50/50.

In surprising news, Mike Tirico is leaving ESPN for NBC. Have him replace Chris Collinsworth and that'll be great...... In all honesty, losing Mike Tirico hurts Monday Night Football a lot as he was a great TV football announcer.
