If they don't want to be taken as a joke so much that alternative player development systems seem remotely plausible, they must show no mercy.

Anyone expecting a death penalty is going to be in for a big disappointment. Truth be told I don't think we will ever see a death penalty in any major Division I sport again. If there was the chance that a big program was going to get the death penalty, it would almost certainly be taken to court and be held up for years with a lot of people siding with Baylor and filing their own suits.
First of all you have Baylor themselves. They certainly would take it to court. It has been nearly 30 years since SMU received the death penalty and nearly 28 years since they started playing football again. However SMU has never recovered and likely never will. There is no reason to think that a death penalty would be less damaging to Baylor. Also another argument they would claim is that they would not get revenue for home football games.
Second you have the Big XII likely filing suit against the NCAA. First of all there would be the loss of 9 conference games unless they wanted to do something crazy like have each team play a team twice. Then you also have the money they would lose from potential bowl games. Also it is worth noting that when SMU got the death penalty it was the beginning of the end for the Southwest Conference and the Big XII is not exactly the most stable conference right now.
Third you have the other schools that were supposed to play Baylor. They would be out of a game as well. For the smaller schools losing that game would result in the loss of a lot of revenue that is needed to keep the football program afloat. For the power-5 schools it is the loss of big game when strength of schedule matters more than anything. Granted they may not officially say they think Baylor is being mis-treated but they will not like it either.
Now I am not in any way saying that Baylor does not deserve the death penalty. I think they should get it the same way Penn State should have. However at the end of the day money talks. Yeah they may lose some scholarships and they may be banned from post-season play a few years. Their punishment though will be a slap on the wrist.

Don't get me wrong, I think Baylor deserves it, but so did Penn State. Penn State ended up getting a slap on the wrist for something that should've ended them. I guess it ultimately depends on how much money Baylor brings in for the NCAA.
