Gah. So. Personal confession time. I'm a former bank employee who dealt with high net worth clients, and I once accidentally deposited $113,000 into the wrong clients bank account. NEITHER OF THEM EVER NOTICED. They may never have found out, except I happened to come across the paperwork about 3 months later and realised what I done. I don't think I'll ever feel worse in my life than I did at that moment. That's not why I'm a former employee, for the record, I immediately owned up to it and luckily the person who had accidentally received the money was more than happy to return it (considering he never even noticed he had it in the first place.) But yeah. Accidents happen. Sounds like they luckily had the ability to pay it back tho and with that type of work they are used to seeing transfers so their wasn't any malicious intent With that couple, they def tried to spend it as fast as they could

Which is very much unlike the couple of this case. I agree they should have immediately contacted the bank, it was an obvious error and they noticed and took advantage, instead of noticing and trying to rectify it.

Everyone involved is stupid. If someone dumps 120k in your account, you gotta assume you’re being set up to take the fall for something!

The only time $120,000 will ever magically appear in your bank account is if you are a government employee and a foreign power is trying to frame you for taking a bribe.

It's the fact that the bank decided to go for the jugular and compound overdraft fees to the point of nearly doubling an already high tab, that's why they're no angels either. Those fees are there because they tried to get back the money that was mistakenly put Mistakes happen and the bank deserves the blame but nah that couple spent all the money, no f***ing way. You earned those fees because you wasn't supposed to spend that type of money like that In terms of the debt, they deserve what they got because they knew it wasn't there money and spent it all anyway. $10,000 sure, but the whole thing, nah you knew what you were doing trying to spend it and thinking you can say we spent it sorry I hope that's not the only reason they levied the fees upon, because that sounds like a very bad strategy to get money paid back to you. "Maybe they're not actually able to pay all the money back in a timely manner." "I've got an idea. Let's make them pay more money total." I'm really only vilifying the bank here because they're certainly not helping the perception that banks only care about money, or at least always prioritize money grabbing over anything else. The implementing of the fees was most certainly just an act for the sake of the money, and you could even say the same thing for when they decided to involve law enforcement. Technically the bank was following the law appropriately, yes, but they just did it to get the cash back.

I'd feel bad (well, I feel a touch bad for then) for the couple but they knew they had no right to the money but spent it anyway. Common sense says you should at least check with bank before buying a car. A nice meal, sure but a car, nah.
Also, we really got to stop taking lessons from board games.

Technically the bank was following the law appropriately, yes, but they just did it to get the cash back. The bank is not wrong though. You get overdraft fees if the money isn't in your account and they were going into the account to collect the money. If the couple said they took the money out and it wasn't in the account they'd have a point to say we shouldn't be overdraft because we have the money in full. However, they do not have the money. The couple loses the high ground when it says they spent it. You didn't call the bank or sit on it, you spent it. The bank was wrong in giving them the money but it was a mistake they tried to clear up. They should still be taken to task tho for that reason because that is a big f***ing mistake I think the overdraft fees are excessive and ultimately it should be waived. The couple will be forced to pay back every cent they spent and whoever had that f*** up will be fired if they haven't already. No one walks away clean from this but I don't see this as big bad bank picking on the poor couple. The coupe wouldn't have had these fees if they were honest and didn't spend it

An insurance company mailed a nearly $3,000 check to my brother's P.O. Box. I made sure to return that thing since there's no way I could've cashed it since it was for someone else, not to mention; why did they mail it to this random Box?
I'm more amazed as to how many people don't change their information once they stop using P.O. Boxes.

I've had a similar opposite happen to me (I deposited $8000 into Savings, but they processed it as an $8000 withdrawal from Checking, and started sending me warnings and threats), so I'd be hyper-aware of what happened.

I think the bank and the people need to both get caught. The bank made the mistake, that's on them. The people though, they saw how much money was in their account and they spent it willingly. Nah, that's crazy. That's....kinda exactly how it works. The bank reimbursed the account the money was supposed to go to.

They’re out of jail on $25k bail, which is a lot more than many people have on hand for emergencies. I can’t imagine they were hurting for cash that badly.

This may fall under Larceny by Finding?
The smart move would definitely call police/bank/lawyer to see your legal standings and rights.

Bail bonds probably, only have to pay 10% upfront for bail. Also, just thinking, if the movie Ghost taught me anything... they should have closed the account and pulled all the money out. Then donated the money to bring back Patrick Swayze.

There have been similar cases where people bought old furniture (or something) at garage sales and it ended up having thousands of dollars in it. Courts have typically ruled in favour of the person who was accidently given the money.
So if a person accidently gives someone money, it's perfectly legal to keep it. if a bank does it, you have to give it back or it becomes illegal.
Sometimes society can be an absolutely cheat. Banks worth billions of dollars should not have more rights than people.

You’re only allowed to steal that much money if you’re already rich.

NEITHER OF THEM EVER NOTICED. That happened to me about three years ago. I'm not by any stretch wealthy, but I live a comfortable financial existence to not have to keep a close eye on my bank balance. On one of the rare occasions when I checked my monthly statements I saw that almost £15,000 had been deposited into my account, sat there for almost a week, untouched, and was then removed.

Oddly something like this happened with my grandma once, where she was accidentally given like $2,000, and she was told they couldn't do anything to take it back without permission, which she gave them because otherwise it'd have to be paid by the person who made the mistake. Might vary depending on the bank or something.
