In theory, you could have felony murder if the DWI itself meets felony standards, which I believe her's would. That's just in theory though. Right. Because Vehicular Homicides or Murder 2 have a lower bar for a DA to clear then Murder l. All are felonies. Well, I was thinking of her number of DUI's making it a felony, and thus making the death felony murder rather than Vehicular Homicide. It's a stretch, and I don't think they would try it, as they aren't likely to get a conviction that way, and even if they did, it would liekly get reversed on appeal. But it is an interesting theory, yea?

If someone kills somebody while drunk and felt remorse and served their jail time then I think they should be forgiven at some point (not by the victims families, but by society in general). But Sunny has shown 0 remorse, and is smiling in her mugshot pic. She deserves at least 20 years in prison if not longer. Not to mention this isn't even her first drunk driving arrest. This is a mistake she has made consistently, showing callous indifference to endangering innocent people. This is something I don’t like talking about, I’ve never shared this story on this forum and I’m normally honest with you guys on everything. I f***ed up a few years ago, drove when I shouldn’t have been driving and got into an accident with a semi. I’m incredibly lucky to be walking and talking today. I am so shit scared of driving under the influence now, I cannot comprehend the mentality of Sunny continuing to drive drunk all the time. I’m lucky I only hurt myself, I just can’t comprehend this lack of caring after so many close calls that should’ve snapped her back to reality.

I'm sorry, but drunk driving is completely unforgivable, fatalities should be treated as first degree murder, and I will die on this hill. Every. Single. Part. of driving drunk is avoidable. It is 100% the result of choices you knowingly make. It's hard to meet the premeditation standard though which is why as far as I know DAs offices rarely bring the charge. The act of knowingly consuming alcohol and getting behind the wheel of a vehicle sounds enough like premeditation to me. We have FAR worse ideas in our system for proving other legal standards.

Premeditation requires the intention of doing harm, not simply a callous indifference to the potential to do harm. That would qualify as depraved heart murder which is in most states considered murder in the second degree, not first degree. The difference here is that depraved heart murder is to behave in such an obviously dangerous way that the killing, while unintentional, cannot reasonably be described as accidental.

Its a very sad state of affairs, I am in the UK so I am not in tune with how it works over there but how on earth does she keep getting access to vehicles, i know with the US its a lot more common to be driving than pedestrian as its much bigger, but damn.

They actually took her license away a long time ago but she was driving her boyfriend's car. Cops can't really follow her around making sure she never drives so sadly she only gets caught if she does shit like this. She SHOULD HAVE been thrown in jail for it a long time before this happened though.
