The sentencing comes after Elizabeth’s team struck out three times in attempts to get a new trial. Holmes’ defense submitted a 3,000 page (!) sentencing memorandum with the prosecution submitting a more sane 46 page memorandum. Despite some redactions much of the documents are publicly available and easily found online.

At the risk of mod repercussion, here goes: Five years, a lifetime ban from ever holding a management position in any company again, and a massive fine paid out of her own pockets along with all the legal costs-and that should be it. Her growing old in jail at the tax expense of the people she ripped off doesn’t fix anything or undo what she did, it just makes society at large feel better to know she is miserable. And she absolutely deserves to be miserable, but to what end does it serve?
And at the same time, her investors don’t really deserve any kind of compensation. She didn’t hold up little old ladies at gun point, she lied to already wealthy people who by every means should have known better. Heck, some of them admitted on the stand that they suspected her but never reported her because they were afraid of being embarrassed by having it exposed they’d been scammed. Just let them all eat the L, none of them will starve for it and hopefully they’ll be a little smarter for it.

A proper punishment would involve banning her from what gave her the most backlash: Messing with folks' blood. Prevent her from working in any medical companies of any kind, that would be appropriate. Jail time would just be the icing, she will get that but she mostly should be made to pay professionally, as well as in money.

A proper punishment would involve banning her from what gave her the most backlash: Messing with folks' blood. Any healthcare company that even entertained the thought of working with Holmes after all this would immediately have all their support dry up and they’d be as dead as her career. Also, a troubling aspect of this ordeal is what Holmes was found guilty of had little/nothing to do with the patients. The woman who thought she had HIV and the man who thought he had prostate cancer due to false positives from Theranos, both those counts she was found not guilty on. She was even found not guilty on count 2 which was the broader charge of her conspiring to defraud patients between 2013 and 2016. What she was found guilty of boils down to her lying to rich people. How the case unfolded sent a message that was unfortunate, but really shouldn’t be surprising: Want to take advantage of the sick and the poor? Go right ahead! But don’t you dare f*** with a rich person’s money!

They're going to make an example of her as she robbed rich, well connected people and her name can be trotted out next time an oil or banking exec gets a slap on the wrists. She revealed the emperor had no clothes, not by speaking truth to power, but by stealing their shoes.

Take the rich people out of the equation and what she did hurt a lot of people because she wanted to take shortcuts. **** her and I hope she rots

There are better ways, just not as satisfying. It's a signal to others who might try the same to not even think about it. In a country where wealth often removes the threat of punishment, I think that's important. No crook grows a conscience watching so some else be on the hot seat, they think they are too smart to get caught. The deterrent is in the risk of getting caught, not the threat of harsh punishment. We need more focus on the start of the process, actually catching frauds, and less on the end, locking them up for decades. Her case in particular should demonstrate the importance of whistleblowers to catching frauds, yet the rewards and protections for whistleblowers are a bad joke.

The sentence is 11.25 years in prison + 3 years supervised release. Sounds pretty reasonable to me. Losing a decade or so is a lot, but she can still have a life when she gets out. Whatever else may be said about her it sounds like she was a hell of a salesperson, so I imagine she'll probably do fine in the long run if she keeps her nose clean.
