A man is trying to sue Disney over the wrongful death of his wife. He alleges that she died last year after having a reaction to food served at Disney World. Disney are demanding he settles and that they cannot be taken to court because it was in the Terms and Conditions he agreed to when he signed up to a free trial on Disney+. Yes. No, I’m not making it up. There are very few people who actually fully read all those Ts and Cs so I imagine quite a few of us agreed to the same thing he did. link

This sounds like the most insane thing to attempt that will somehow work.

Not that it's any kind of secret, but as time goes by, more proof emerges that the Disney corporation is slimy as f***

and people wonder why I use the phrase "That's Disney evil!"
I wouldn't be shocked to find in the T&C's of disney+ they include signing over your soul and those of the next five generations of your family.

That cannot possibly be legally binding, surely?

Disney kills you it aint their fault because you watch their stuff.
That is real life deathnote..except instead of a book it is the fact you signed up for their product.

And I contend those guests were decapitated before they entered the Disney World House of Knives!

That a clause in the T&Cs of a streaming service can carry over to the parks is ridiculous.

The irony. Disney wanting to keep this thing quiet has exploded it into the news cycle.
Also, assuming I'm understanding the whole thing right, the "free trial T&C" excuse won't eliminate the case, it'll just send it to a different method of resolution, and perhaps for a smaller cash amount they would need to pay up. Either way, I can't imagine either method rules in Disney's favor. Like, seriously.

That's a Simpsons subplot I'm pretty sure. Did South Park have a story about not reading the terms and conditions?

And I hope the judge increases the payment because of Disney trying this.

IANAL, but feels like it's gotta be dubiously legal to put clauses covering things not germane to the product or service on offer in a T&C.
