That's what I heard JR blurt out during Taker/Mankind HIAC at King of the Ring 1998. He might have actually said "he", but I kinda doubt it.
What puzzles me is why he opted to use "they". Did he accidentaly lapse out of kayfabe and reference the booking team (in the sense of what they "did" to Mick Foley's health), or did he just bumble his words out of shock?

Most likely, it was just a slip-up of words on JR's part during, in my opinion,. the most genuinely emotional wrestling call, ever. Also my favorite commentating moment of all time. Some people like Vin Scully's call of Kirk Gibson's game-winning home run in the 1988 World Series: www.youtube.com/watch?v=bMe6y7i2I7g&feature=relatedOthers prefer Bobby Thompson's Shot Heard Round the World: www.youtube.com/watch?v=lrI7dVj90zsamongst countless others. But bar none, when Foley gets thrown off, is the best call ever.

But they couldn't prosecute Taker if they'd killed Mankind cuz Taker's already dead.
...kayfabe?
And the "they" JR referred to was video killing the radio star. It's one of his favorite songs. He's got a ringtone of it on his cellphone.

JR did not say "he"; he said 'That killed him!"
