I'm also going to point out that wether he deserved it or not (by wether or not he hit Aries) then he still could be found to be at fault over what he did or did not say to Aries. There has been plenty of presedence in the court system (I just worked a case like this not that long ago) where if what you said fell under the context of "fighting words" than it's your own fault.
Also, another problem that he might run into is the fact that he went onto the internet so quickly and told 'his side of the story.' This CAN and WILL be used against him if this went to court. Also it could be used as a case of him trying to contaminate the potential jury pool.
You know, if Aries did hit him he could have quite literally sued the pants off of him (and ROH by extention) but he has done so much to destroy his case that any lawyer that Cary is likely to have can win this with his eyes closed.

That's where "fighting words" can fall into play. Again, I have no intimate knowledge about this case, but the kid has more or less torpedo'd his case from the outset. Even if he didn't go up to Aries before the show and say anything to him, his words can be used against him to show he's unreliable and not to be believed.

All I know is, referee Paul Turner is a hero for getting the guy into a chokehold and throwing the douche's hat into the crowd.

Legality aside, from a simple common sense standpoint, if you talk smack about a guy's girlfriend in the way he did you should expect to get decked. It's something called "Don't Poke The Bear." If you deliberatley try to piss someone off and get pounded, don't act surprised. If the guy really said what was reported, that he wanted to get with her, then the f***er had it coming.
However, this is America and no one is reponsible for their actions anymore. He'll probably win even though this thing is entirely his fault.

I'd think ROH is fine because if Aries is employed as an independent contractor.. then his actions are his own. If you remember the Sandman/Fan Being Pushed Over Suit... WWE quickly moved to get their name off the suit for this reason.

If this was a physically unprovoked attack then I hope both Aries and Ring of Honor are ruined by it. Why would you want a company to be ruined because of one man? Why would you want many of the wrestlers and personal of ROH to lose a big source or source of there income that is used to support themselves and families?

There is a difference.

A video of this incident would be nice because I don't 100% trust the reports from the ROH board because they are going to side with ROH/Aries and I'll never trust DOI because of their holy war against ROH. I was actually AT the show last night, and from what I can tell, it's hard to say. I saw Aries shouting at a guy from the entrance, and some guy's head waving around inthe air like a maniac. But I'm not entirely sure what happened. (I was on the other side of the arena and even standing on my seat (like most of us in that section had to do every few minutes just to see what we were watching), I didn't see this guy take any shots at Austin, but neither did I see him get punched out while he was in the arena. I DID see him get dragged backstage though, which means he couldhave been attacked backstage. But beyond that I have no clue. I actually talked to the guy who runs ROH and he seemed like a genuinely decent guy. So I don't think the allegations of Cary suddenly showing up in front of the guy with a cigar in hand is very likely.

this is what I read
- Regarding the incident between Austin Aries and some fans last night, as Aries was leaving the ring, a fan grabbed his shoulder and spun him around. Aries felt as if the fan was going to hit him, so he laid the fan out with one punch. From there, a friend of the fan tried to jump the railing, and Referee Paul Turner got involved at that point to stop any further altercation.
