The original nWo theme was called Rock House by Frank Shelly. Its from a music library so I think TNA actually could use it if they bought the rights. Rememeber how Scott Hall would allude to the song being "the tune from your favorite porno"? Thats because it actually WAS used in a porn film.

Another pet peeve is the segment where TNA fans said they were tired of wrestling for kids and the PG stuff, when Hulk Hogan was the first big wrestler to appeal to kids and turn wrestling into PG malarkey. It is amazing the cognitive dissonance. Denounce WWE as too kid friendly and to create a change bring in a guy that was the first character to target kids and bring them in. Most of the older fans of today that love Hogan were kids when they started liking him...which is makes the irony too strong to bear for me. True, but Hogan was also the first big wrestler to do the whole "adult, edgey" stuff with the NWO. IMO, the current Hogan in TNA is like a hybrid of of the "Hulkster" and "Hollywood". So while the fans know that Hogan was the first big wrestler to appeal to kids, they want to showcase him as "Hollywood" just so they can counter the WWE's current PG product.

The NWO theme (Rockhouse) that is most familiar to people is not just a mixture of Jimi Hendrix songs. The song does sample at least three Hendrix, most notably 'The Stars that Play with Laughing Sam's Dice' but also 'Highway Chile' and 'Hey Joe.' The theme is owned by Focus Music. TNA must not want to pay to use this music (and WWE apparently doesn't either as they dub over the music in recent DVD releases).
Also, it has been suggested that TNA should use the Wolfpac theme since Jimmy Hart wrote it. It is very much likely that WWE acquired the rights to this song when they purchased WCW's assets. We know they own the New World Order name and 'NWO' and they very likely also own 'NWO Wolf Pac' or 'Wolf Pac' with varient spellings like 'Wolf Pack' or 'Wolfpac' etc. Of course by this point I believe they would have needed to renew their copyright of the WCW-related assets they acquired. Some of the WCW trademarks have reportedly not been renewed, though I can't think of any specific examples.
The theme they are using is probably their best option and I have no problem with it.

Are you sure WWE doesn't own the NWO theme? I was watching WWE Classics and noticed that they still use it.

I am pretty sure the music piece (titled 'Rockhouse') is owned by Focus Music, a production music library. I believe WCW had the rights to use the theme for a certain number of years through Focus Music and when WWE purchased WCW's assets, they had the rights to use the music until the original deal was up. When the deal expired, WWE chose not to pay to renew the rights to use the music. WWE.com recently made a list of greatest music and the NWO was mentioned, but it could not be previewed unlike other music from the list which WWE owns. You mentioned WWE Classics using it and I believe the Rise and Fall of WCW also keeps it in tact, so WWE must have paid the royalties to use it for some of the old footage. They sometimes choose to do this with other music as well.
