(12-10) 10:42 PST DETROIT, CA (AP) --
A 20-year-old Burger King employee who was arguing with a customer in a crowded fast food restaurant punched the 67-year-old man, who fell and later died, police said Friday.
The punch may have caused the older man to choke on his dentures, WJBK-TV reported.
Police said the customer was reportedly causing a disturbance Thursday afternoon at the restaurant on the city's east side and tried to hit the worker, who swung back.
"A verbal argument occurred," police Sgt. Eren Stephens told The Associated Press. "It escalated into a physical altercation."
Jerome Perdu, 59, of Detroit, works as a security guard nearby and said he was at the restaurant at the time. He said he didn't see the customer get hit, but watched as paramedics tried to revive him. The restaurant was crowded at the time, he said.
"I just seen him lying on the floor," Perdu said. "EMS was pumping him."
The man was taken to a hospital, where he later died. An autopsy expected to be conducted Friday was to determine the cause of death.
The employee was being held Friday and could face criminal charges. Stephens said that once the investigation is complete, the details will be submitted to the Wayne County prosecutor's office for review.
Around midday Friday, a sign on the restaurant's door indicated that only the drive-thru was open, and a steady stream of customers pulled into the parking lot. A manager who opened the locked door said any comment would come from the fast food company.
Denise Wilson, a spokeswoman for Miami-based Burger King, said Friday that company officials were aware of the incident and the franchise owner was cooperating with police.

While I'm not saying I condone the man's actions, the older gentlemen did give him reason enough to defend himself. I doubt he intended on killing him.

Wait wait wait... If a customer takes a swing at you, I thought people behind a counter had the ability to unleash hell.
There was a guy here who was unarmed and tried to rob a liquor store. He got shot and killed for his troubles. The law said the guy behind the counter was practicing self defense.
I'm definitely not condoning hitting the elderly, just wondering why he's facing criminal charges?

I'm definitely not condoning hitting the elderly, just wondering why he's facing criminal charges? Because he punched and killed a guy Eh this is a sticky situation. Hell, the sentence that you just typed is not very common. If someone swings at you, generally it is instinct to either run, push, or swing back. Granted, if a 67 year old man swings on you while you're at work you should probably not swing back, Then again, it's not like this guy is just a complete psychopath and deserves to be charged with murder. Manslaughter maybe. I seriously doubt that anybody would have the same attitude about this if the customer that was killed was the same age as the employee.

It all depends on the circumstances, which are notoriously hard to discern from news reports like this. If the old guy was pretty feeble, a straight up punch to the face by a 20 year old might be considered excessive.
Don't forget potential civil penalties.

I agree but as formallity they'll nee to complete some police action to close the death. That may mean charging him if the local prosicutor sees merit in doing so. If he does than the employee needs a decent lawyer who'll quote stories like store clerks beating down or shooting robbers/assailants in order to clear his name.

Yeah, even if no charges are filed, they pretty much are required to take him into custody, at the least to get him out of that situation.

Old man takes a swing a guy, said guy retaliates, a freak accident happens and old man dies. Its unfortunate but I hope the guy can get off on a minor charge. It's worded as if it was self defense turned wrong and just because the man was elderly doesn't make anymore wrong or right in my book.

Here in my state, people behind the counter are legally not allowed to do anything except call the cops.
