i will try to make this as short as possible!
Feb of last year i sold some stuff..flat screen tv, xbox 360 and like 25 games so my girlfriend could have some money for a downpayment on a new car. I loaned her 1,000 total and we had a verbal agreement only that this amount would be paid when she got her tax money next year ( this year).
We lived together and in May of last year, i purchased a home in another county and we moved... IN June of last year again I loaned her some money because her first car didnt work out and i actually bought her a $1600.00 van. the money used was money that was to go towards the house i had just purchased....We were under an agreement that this money was to be paid by NOV 1. We were together and we would of works together to come up with this.
In August i found out she was cheating on me, and i kicked her ass out. We still talked and she still swore to pay me the $1600.00 owed by NOV 1.. and the $1,000 when she got her tax money....Nov 1 came and went and everytime all she had was excuses.. ( i had to buy this, my son needed this) and because i cared, i let her get away with it... we made another verbal agreement that we would total the 1600.00 she owed me with the 1000.00 she owed me from February, and that whens he got her tax money she would pay me a total of 2600.00. She made a payment of 1,000 to me in late nov, but im still owed 1600.00
I tried to contact her seveeral time and she ignored me, i texted/called everyting and i got ignored or told that this wasnt amanda anymore... I eventually got ahold of her and she yelled at me and said she had to fix the van and blah blah i should of been saving my money to cover it for her....
My question is...im wanting to file for small claims... I have no written agreement, but i can subpenoa to get the dozens of text records of her avoiding me, of her promising to pay, yadda yadda. I also have a text from her dumbass boyfriend threatening to kick my ass if I message her again, and also one of him saying "Im the reason she didnt pay you what she owes".... Im curious though... where do i file? I have been told i have to file in the county it took place... would i have to file in 2 counties ( the county the 1,000 was loaned, and the county i live in now where i loaned her 1600.00 to buy the van). The clerks offces basically have no idea what to tell me so im lost..
also do u guys think i have a good chance of winning in small claims? I can get text records, and I have witness's who will support my story... she has nothing. ANY HELPS GUYS?...
where do i claim?
