Honestly, I find screenshot Let's Plays to be much better anyway. So do I, usually, but retsupurae makes me always want more video ones.

What's ironic about Retsupurae is that Slowbeef himself is widely credited with having started the entire Let's Play phenomenon to begin with. Supposedly the early screenshot LPs on Something Awful were largely inspired by a Metal Gear 2 "Strategy Guide" he wrote for his personal website in 2004. He also did the first known video LP in 2006. It's kinda funny that he's now better known for mocking this shit than for creating it.

Or learn of Bowser's evil test? I wish we could teleport, like Luigi, to a simpler time. Don't be such a bummer, man.

Reviewers would be f***ed. As a person that only waits for a capture device to arrive so I can start "reviewing" on my own, I am pissed and scared. My favorites would be in jail, servers would be down.... The Internet? Desert....

I've been doing a lot of reading around and it seems this law is more in the name of streaming. The laws in place have ALWAYS been in place, this just ups it to a felony instead of a misdemeanor. And the law (alongside the DMCA) protects Youtube and other video hosting sites, just so long as the user isn't making money.
While it can be interpreted to add youtube videos of different varieties, the DMCA protects Youtube. Videos get yanked all the time on Youtube, but nobody gets fined for it because 99% of the people aren't making money. Seems to me alot of youtubers are just now being made aware of a law that's actually already there.
And this addition in general is old news somewhat. Google it and you can find it's came and gone in different ways since 2006, maybe even before that.
They're really not doing anything new, just upping the penalty for what is already there.
And a lot of the reviewers from what I see aren't sweating it thanks to fair use/parody/satire. If they were at any risk of being in trouble, action would have probably been taken. Even if it is the internet, they aren't exactly obscure.

I really hope that fair use is above this.

Butch: "So, what are you in here for?" Butch's new Cellmate: "I...uh...I uploaded a Youtube video of me playing Super Mario 64." Whilst I hope this law doesn't pass and I hope nobody ends up in jail, you gotta admit that the thought of the above scenario happening is amusing.

You guys do realize that LPs, the mass majority of ThatGuyWithTheGlasses, and things of the such are ALREADY illegal, right?
They can claim Fair Use as much as possible, but TGWTG is full of blatant copyright infringement to the point that their own people admit it:
Now, fair use is fair use and always a helpful thing. Bill S.978 won't stop legit reviewers and journalists because of fair use. Small snips of footage isn't copyright infringing and companies don't try and take too many to court (and usually lose if they do).
So...yeah...Let's Plays are already illegal, it's just most companies don't care because it can occasionally spark interest in their product. Most people can avoid problems by not making profit or actually licensing the games.
I'll stop rambling now.

^ There's no way to know if TGWTG would fall under fair use unless it's taken to court.

They are protected by a) fair use b)review c)parody it's not like they share full movies. they use like what 10 minutes from the film/whatever? Fair Use may be used for the movie being reviewed (as to why Tommy Wiseau's attempt to take down The Room review ended up not working) but using clips from other movies for jokes is infringing on the copyrights of those movies. That's what Nostalgia Chick discusses in the video I linked (with Linkara sounding very annoying in a "I can't hear you, la-la-la-laaaa" kind of way). She goes to film school and learns these things. And I don't understand the "Parody" thing. If Doug himself would throw on a white wig and shout "GREAT SCOTT, MARTY!" then sure, that's parody and fine, but just showing Christopher Lloyd shouting it is...well...copyrighted footage. It's just that the companies don't care. But, it's the reason he was taken down from YouTube and if Blip.TV gets big enough that big wig executives come across it, they can get him taken off there, too. Blip is just very lenient. Again, to reiterate what Lindsey "Nostalgia Chick" Ellis said, "What are the odds of being sued...not good, but entirely possible." I'm not saying that should go to jail and are horrible people. I'm just saying that they walk the line of copyright and dip over it from time to time...but those who could sue them haven't (and probably won't). A new law won't stop that anytime soon since it would still have to be enforced.

The worst that could happen to TGWTG is that the reviewers cant show any footage from anything EXCEPT the movie/tv show/comic being reviewed. I wonder how it would affect the commercials videos (the ad campaigns being shown are long since retired, and 90% of the products featured are no longer for sale).

Yeah, the reviews that NC does are fine but shit like "OF COURSE!" and the repeating jokes, those most definitely wouldn't be fair use. I'm sure if they got a good enough lawyer they could try to find a way to argue it. But yeah, the worst that would happen is that they'd have to stop using those jokes.

Maybe he should film footage of him in an M. Bison costume yelling "OF COURSE!" just to be on the safe side.
