Okay, I can totally understand the reckless conduct. Hell, I'd even undertand an involuntary manslaughter, or negligence causing deat, but how the hell does SHE get charged with vehicular manslaughter?

The drunk driver probably wouldn't have stopped for them at a crosswalk.

The drunk driver probably wouldn't have stopped for them at a crosswalk. The driver should be doing the hard time here. Not her. Hypothetically, if she walked to the crosswalk, the driver might have driven by when they weren't crossing. While I agree that the driver, who was drinking and on painkillers, should be doing time (and I don't know if he is or isn't), what she did was negligent. I know jaywalking is on the low-end of the totem pole of crimes, but her decision to cross did have a direct impact on the accident happening. It shouldn't have been vehicular manslaughter, but she still shares some of the responsibility.

After reading the article and watching the interview I believe that she was at fault. Cross walks exist for reasons like this, had the mother followed a simple law put in place for public safety her child would still be here today. The report said that the man had been drinking earlier in the day that doesn't necessarily mean he was drunk at the time of the incident. I feel that he served a proper sentence for the hit and run and had he stayed at the scene he wouldn't have served any time unless he was intoxicated. The mothers negligence is what ultimately caused the accident to occur so from a legal standpoint she deserves to be punished.

She openly admitted that after the boy ran out into the road, she yelled to stop so he did, and she thought it was clear so she said keep going and that's when he got hit. She's definitely at fault here. I just don't get how they arrived at vehicular manslaughter as her charge
