Production wise it's obvious why he's not there, but you'd think a conniving man like himself would have taken advantage of the chaos in Gotham. Was there a deleted scene or unused part of the script that says he was sent to a federal prison or somewhere else outside of Gotham? You'd think one little line could have cleared it all up.

According to the novelization tie-in, they left him in Arkham. He probably escaped while everything was going on with Bane.

I imagine The Joker and the rest of the rest of The Arkham inmates watching Blackgate get liberated and The Joker thinking "Ok, we gotta be next!" and becomes more and more agitated as the days go by and they have yet to be sprung.

You would shift focus from the new villain by even mentioning such a huge heel. It would steal Bane's heat and after the mention one of two things happen. Either folks are burned by such an offended mention of a power player or fans are then waiting for him to join the story in someway and get distracted from the plot and logic of the new bad guy you are getting over. Good call not mentioning him at all IMO.

Scarecrow got out, though, and he likely would have gone to Arkham, himself. It's possible Bane just wouldn't be stupid enough to expect Joker to be a reliable facet of his plot.

Well, I don't think Crane was crazy so I don't believe he'd be in Arkham. When he was caught in Dark Knight, he was dealing drugs so I think he'd be in Blackgate. Also, since he was an accomplice of Ra's Al Ghul in Batman Begins, Bane would be aware of him and let him out.
I'm sure the League of Shadows know what a wildcard Joker was and not even touch. They wanted an army anyway, many of the Blackgate prisoners being soldiers in Organized Crime, would be more their style than the imbalanced in Arkham.

Crane was good pick for the kangaroo court. Joker, if he is not being held elsewhere, would more or less probably be seen as a symptom of Gotham's disease to them, anyway.

Considering how Ledger died well before they ever wrote TDKR, I would think any usage of the Joker for this one was deleted from the Nolans' mindsets long ago. The Scarecrow role was just using Cillian Murphy again as a fun cameo (like they did with him in TDK). Judge Joker would've never gone as straightforward as what Scarecrow did in this one.

I always imagined he got the death sentence, transferred way beyond Gotham, or Bane knew how much of a wildcard he was and would of conflicted with him on ideologies that he didn't release him on purpose.
