Court makes man pay child support for 3 children not his own

MONTREAL - A father has been ordered to pay child support to his ex-wife despite results of DNA testing that found three of the four children he helped raise are not biologically his, a Quebec Superior Court ruled.

The man learned the shocking news after he demanded DNA testing when he and his wife of 16 years separated in April 2010.

“Since I learned that I am a broken man,” the father told QMI Agency.

His daughters are aged 12, 14, and 16, and his son is nine. DNA testing revealed the son is his only biological child.

To make matters worse, his ex-wife told him his three daughters were all fathered by different men, he said.

The man said he was aware his wife cheated on him several times, but was floored when he discovered the results.

“I was naive ... I never thought I could not be the father of my children,” he said.

It sucks to learn this but sperm alone doesn't make you a father. He stayed there and claimed these children as his own despite knowing his wife was cheating and this was possible. If he views them as his kids like he says, he can still be responsible, be the father he's been for 16 years. He's been these kids father for their entire lives and I'd hope this wouldn't end that. Don't make the kids suffer because your ex is slut.

I agree with that, but there's a major difference between choosing to continue to love and support the children he raised and being court ordered to pay his slutty ex-wife at least once a month.

I feel weird about this. I mean if I was in his shoes I'd be devestated, (I also would have asked for paternity tests right after i knew she cheated) but I dunno, I guess if I had raised 3 kids for 12-16 years I'd probably love them as my own and wouldnt want to step away. Tpough situation

My main concern is the kids. I don't want them to suffer because mom couldn't keep her legs closed. As bad as I feel for the guy, he should help support them despite this.

This is crap.

The guy can want to help out the kids, but there is no way a court should be legally making him.

The court has no grounds to do that. Biologically, he has no parental rights to those children, so he shouldn't have to pay. If this ruling has given him rights by proxy, he should counter sue his slutty ex and take custody.

I'd be appealing the hell out of this.

I would agree with that, but there are a few problems to me:

For starters, it seems only fair that the biological fathers would take responsibility for their actions as well and pay child support for the kids they fathered. By the logic that sperm isn't all that makes you a father, no man would ever pay child support to a woman they only ever had a one night stand with.

Second, as Citizen Grimm mentioned, I think the real problem is giving part of his earnings to a woman he no longer has any sympathy for and who obviously never respected him (if she hadn't cheated on him on multiple occasions, he would never have had to raise them to begin with); of course, this money is supposed to help the kids, but if I were in his shoes, I couldn't help but keep the thought that she may use it for other purposes on the back of my mind.

Third, he obviously can't be the father he's been for 16 years as he won't be able to actually live with his kids any more. Sperm isn't thte only thing that makes you a father, neither is money. And that's my biggest issue right there. Since he will be separated from his children, isn't going to be involved in their education any more and didn't even father them, it doesn't exactly seem fair that he would have to pay for other people's actions. They're basically punishing the only person who's shown some responsibility so far.

I hate the power courts have over child custody/support/etc. It needs checked. They just run roughshod over people's lives. Where's the limit?

Hell, I've even known a couple that had a kid, got divorced, and had the courts intervene and decide the terms of custody and support for them despite the fact they stayed friendly and had it worked out for themselves already.

Dude wasn't even an actual father. How in the hell can this fly? Can we debate the legality of a cut and dry scientific issue now?
