For whatever reason I was watching the Kiss Demon's WCW debut on youtube and I was wondering if WWE edits out that performance when they show this episode of Nitro on 24/7 because I imagine they would have to buy the rights to use the song any time they want to show that performance. For that matter, do they edit out all of their musical performances on their own ppvs and episodes of Raw when they show them on 24/7?

They clipped Motley Crüe from the Monday Night Raw in 98, so it would be assumed that they would do the same for KISS.

This is a company that edited out all Jimmy Hart's music off the WrestleMania Anthology because no one bothered to ask permission. Somehow or another he found out and said he'd be honored if they used his music (and I'm pretty sure didn't ask for money to do it) so it was back in for the SummerSlam sets.

It's weird how the law works because you'd expect WWE would be able to reproduce anything that happened on their events.

I don't know if they would have to edit it though, there is a difference between showing footage and selling DVDs of said footage. I know the Classics/On Demand service makes money but it's all contractual depending on if they would have to pay royaltees. If the showed it on WWE Vintage Collection I'd say they wouldn't have to edit it. It all comes down to if they are making money of the distribution of the performance.

Any of their outlets for footage would be considered distribution for financial gain, even if indirectly tied to the music involved. Any use of it, even posting it on their youtube channel, would legally require them to gain permission and pay fees/royalties. Whether they show it on free broadcast NBC, cable USA, PPV, their own on-demand network or free youtube, somebody is making money.

If they initially had contracted for the performance rights in any form, they wouldn't technically need to ask for permission. They might just find it easier to edit rather then go back and find the contracts and double check.
