Looking at how it all unfolded, it may have been possible that Stewart couldn't react in time to avoid Ward. The car in front of Stewart looks to have blocked Stewarts vision and by the time it moved to avoid Ward, it was to late for Stewart. Hard to tell since we only have that one angle. This is pretty much how I see it as well. Ward shouldn't have been in the middle of the track like that. If Stewart didn't hit him, it would have still been likely that someone else would have.

If Tony was angry and wanted to buzz close pass the guy or spray him with mud and then ended up hitting the driver because of that, he could end up being charged criminally liable as he was being reckless. A dark ugly day for racing.

The kid should have plain and simple stayed in his Car. I could understand if the Car was on fire or something, but all he did was spin out. He had to have considered the fact that Cars were whizzing by him. After the first one did he could have went to his Car and waited for Caution. Instead he ran around in a Panic and inevitably, it cost him his life unfortunately.
I don't blame Stewart for this but racing today like he is apparently going to do seems insane. I don't know how he can even be mentally ready for a race after that...

Common sense would alert them that perhaps putting a guy in a race car again after being involved in a death may not be the smartest move. Plus NASCAR, come on now, I don't think your rule back is THAT specific.

Having watched the video
I think the guilt can be thrown onto both sides.
Ward should not have gone onto the track like that.
And Stewart tether he meant it or not shouldn't have reacted the way he did.
An unfortunate accident that cost somebody their life.
But one that could easily have been avoided.

I don't blame Stewart for this but racing today like he is apparently going to do seems insane. I don't know how he can even be mentally ready for a race after that... Everyone has their own way with dealing with tragedies. Stewart is a racer. It's basically his life. It's how he deals with it. Plus it's not like he's racing in the same type of car or on the same type of track. These stock cars are some of the safest racing cars in the world, and the faster Stewart feels comfortable behind the wheel again, the better.

It has been announced that Stewart will NOT be racing today. Regan Smith will drive the 14 instead.

Probably the best until all the details about this iron out.
I don't really want to get into the realm of victim blaming, but seriously, dude should not have been out of his car, in the racing line, in a dark firesuit, on a slick track. It could've just as easily been the car in front of Stewart hitting him, and I'm pretty sure if that had happened people wouldn't be calling for Tony's head.
I swear the bloodlust any time any public figure is involved in a situation like this is completely ridiculous.

It's best for him I think. I know racing is his passion but a lot is going through his mind right now and he just needs some calm time to himself.

Contact is not an uncommon thing in dirt track racing (I've been watching winged sprints for 30 years now), where the most effective way to pass is to throw your car out in front of the path of another going through the corner, forcing them to back off of their acceleration so that they don't hit you coming out of the corner. And of course, drivers get angry, and stupid, and run charging at another car, usually to yell at that car's driver or do something stupid like try to pull the plug wires out of their engine. Especially a young driver like Ward will tend to be hot-headed like that. I haven't seen the video, so I don't know if Stewart could or couldn't see Ward coming at him, but it was horrible judgment by all involved.

I have noticed so far that it seems like a lot of the people with the torches and pitchforks are people who don't really like NASCAR to begin with and are drooling at the prospect of this scandal somehow taking out Tony Stewart and doing irrevocable damage to NASCAR too.
Seen plenty of Armchair Prosecutors, but I haven't -yet- seen someone calling for Stewart to be executed. Then again I probably haven't been looking hard enough.

I am sure you could find that there are enough people who are positive that Tony Stewart intentionally hit someone with his car. Near as I could tell by watching the video the one time I could stomach it, I don't blame Stewart at all. Anyone who has ever hit an animal that darts out in their way on the highway would know just how hard it is to avoid such an impact. Add to that the fact that it was dark, there was another car in the way to block his view until it was too late, and the simple fact that Stewart's attention would have already been split a minimum of 4 ways (the car in front, the car behind, the track, and Ward's wrecked car that he was getting ready to pass) means that he probably could not have seen him until it was way too late.
