This is gonna sound harsh, but while I know we're inclined to side against the WWE in this one (and for good reason, as the only way they keep him around is to make money on merchandise sales), I gotta side with them here.
Rey wants to wrestle, and that's all he wants to do. However, his body can't take much more of it, thanks to a combination of a risk/reward style offense and relying on an inferior surgeon simply because he's based in San Diego. If he goes to AAA, he'll want to be a focal point and, in spite of the easier schedule and shorter travel distances, Rey would still want to do all the moves his fans expect him to do.
When a pro wrestler gets older, they normally dial down their offense to focus more on what works to get crowd reactions, so seeing guys who still want to go into overdrive every single night as they near 40 isn't particularly smart. Even if the WWE is pretty stupid for wanting to keep him around for sales of his masks and shirts, even letting younger and/or more capable talent go just to pay Rey, at least it seems that they don't want him to make that final mistake.
Of course, if Rey gets out of this deal, that would be a good thing, and if AAA is smart by putting him with a techncio trio that consists of two younger guys that can help carry Rey so he doesn't have to do as much, it'd be perfect for him.

If Rey is still under contract, aren't WWE perfectly entitled to do whatever they like with him, even if that's just paying him to stay at home?

It's sad when any athlete can't hang it up. Rey should have the good sense to know when it's over. Flair didn't; he had to be out out to pasture. Derek Jeter is retiring on top. Jim Brown did. There might be something dreadful to come out of this final mental run. If AAA is stupid enough to want to be a part of it, it's on them.

they should let him out of his contract if he doesn't want to be there and they can't use him in any meaningful capacity anyway. that said, if he gets let out and cripples himself in AAA that'll be on him, and AAA would be horrible people to let him do that.

It does seem a bit Orwellian. Maybe recent examples will teach people to read their contracts first. One day someone's going hire a decent lawyer and then they're screwed. The majority of stuff in WWE's contracts is protected under law and not out of the ordinary. If Rey was being paid to sit at home and do nothing, WWE is fully within the right to extend his contract, especially since he's still going to be paid to once again do nothing. Now if WWE tried to sign him in perpetuity, that would be illegal.

Rumor is Rey would fail a drug test on purpose just to get fired Actually, wait, why doesn't he just do that? That would solve the problem. But yeah. Rey Mysterio's an idiot who's going to cripple himself and has no business being in the ring, but if he wants to do it it's not WWE's place to stop him from doing so.

What's with all these comments about Rey destroying or crippling himself??? Did anyone ever think that maybe he'd be used as a special attraction in AAA like he should have been used in the WWE over the last couple of years? I'm sure he'd hold some office position in AAA as well since he's buddies with Konnan. I don't believe he'd be killing himself in AAA when he could help the company out in so many ways with just his presence alone.

Most of his masks and merch are bought by kids so being the first guy fired for three strikes under the wellness policy would do him no favours whatsoever when he tries to market his likeness himself outside of the WWE... Besides, there's nothing to say they won't just shift the goalposts like they have with Orton and claim one of his strikes doesn't count.

Everyone keeps saying that if Rey does go to AAA and hurts himself badly then it would be on Rey and AAA but that's not true. Mainstream media is going to spin it that another pro wrestler ruined his life at a young age and that always reflects on the WWE simply because they're the biggest company out there. If, God forbid, Kurt Angle wrestled a match with TNA tomorrow and dropped dead the media would report "Former WWE Champion Kurt Angle dies at wrestling event" nothing in the headline would be about TNA, therefore the backlash from the general public would be against the WWE.
As far as the Rey situation goes, they should just let him go. He can't wrestle a full schedule or even a part time schedule anymore and he wants out. I know they're concerned about not having a big time Hispanic star but even with Rey under contract they don't have one because he never wrestles anymore.

It's funny how you can say Jericho and Mysterio started about the same time and went to the same places yet Mysterio cannot go one complete match without being hurt while Jericho is doing every single move he did 20 years ago with only a broken arm as an injury in his career.
