If Digital Homicide's games are shit (which they kinda look, to be frank), why is Jim Sterling or anyone else not allowed to say so? It shouldn't matter how many games from the same publisher are reviewed by someone; it still sounds like "freedom of press" to me.

The one silverlining out of this is it'll bring more attention to how broken Youtube's copyright claim system is.

I cannot wait for the cringe.

Don't like Jimquisition, and don't see why that seems to have a following here, but this is a bogus lawsuit. I'll take the whiny hack critic over a crappy game studio that employs censorship any day.

I like that ONE guy calling their game bad did them over $4 million in emotional damages. How much can I get out of the review I got on one of my comics that got the artist's name wrong?

It won't work because it's a review. It's not illegal to share his opinion on something.

Hell it could in fact backfire on these guys, as apparently they've stolen a shit ton of artwork and other assets to use in their games, and if that gets brought up, with solid evidence, then they might just be up shit creek without a paddle.

"Digital Homicide then cites a line in which Sterling states that “apparently you don’t need to prove your company’s legitimacy or even existence, since it’s all based on usernames”. This references Digital Homicide publishing games under a different name, which Sterling perceived as disingenuous to players. Digital Homicide alleges that someone named Jim Stanton publishing videos under the name ‘Jim Sterling’ is no different. “[Sterling] makes the above statement in a negative way to make it seem to his audience that normal business practice is somehow being abused,” they argue."
I'm actually on DH's side on this one. This world would be a much better place if people are held responsible for their words/claims/hypocrisy online.

There's a huge difference between hiding the name of a company to try and mask a negative reputation and using an alias as an entertainer.

It won't work because it's a review. It's not illegal to share his opinion on something. It wasn't even a review, it was a 10 minute quick play impression deal. Then is spiraled, it is really fascinating to watch the videos involved.

Libel and slander, heh? Have fun proving that considering, you know, Sterling didn't say anything untrue. In fact, THEY are committing slander with this accusation. Also, I take it these people never heard of the Streisand effect, then? The one silverlining out of this is it'll bring more attention to how broken Youtube's copyright claim system is. While YT's copyright system is indeed broken, this has nothing to do with it. They're suing, not making a claim (although they did do that earlier). "Digital Homicide then cites a line in which Sterling states that “apparently you don’t need to prove your company’s legitimacy or even existence, since it’s all based on usernames”. I'm actually on DH's side on this one. This world would be a much better place if people are held responsible for their words/claims/hypocrisy online. These two situations are nothing alike. While Sterling does use a pseudonym, he makes it very clear who he is, doesn't do so in an attempt to scam people. And also, doing so is not illegal so to bring this up in a court case is entirely irrelevant. On the other hand, I'm pretty sure lying about your company's identity IS illegal and even if it isn't, criticizing a company for doing so certainly isn't illegal either and since Sterling isn't making any false claim, it is once again irrelevant and has no reason being brought up in an accusation of libel and slander.

I should also point out that the alternate name Digital Homicide used to publish their... well I suppose they technically are games, is the name of another company which appears to be completely unrelated to them. So yeah, they used another company's name to publish their own rubbish, violating a shitload of copyright laws and causing harm to a third party. So once again, what they did has nothing to do with Stanton using "Sterling" as a stage name. It'd be more akin to him posting his videos under the name "JonTron" or "Angry Video Game Nerd". And then suing people who'd go "yo dude, what the f***?" in the comments.
