Ricky Labit, a 6-foot-3 disabled offshore worker, said he had been a regular at the Manchuria Restaurant, eating there as often as three times a week. But on his most recent visit, he said a waitress gave him and his wife's cousin, Michael Borrelli, a bill for $46.40, roughly double the buffet price for two adults. "She says, 'Y'all fat, and y'all eat too much,'" Labit said. Labit and Borrelli said they felt discriminated against because of their size. "I was stunned, that somebody would say something like that. I ain't that fat, I only weigh 277," Borrelli said. Accountant Thomas Campo, who spoke for the restaurant because the owner's English is limited, said the men were charged an extra $10 each on Dec. 21 because they made a habit of dining exclusively on the more expensive seafood dishes, including crab legs and frog legs. "We have a lot of big people there," Campo said. "We don't discriminate." The argument over the bill grew heated, and police were called. The police report states that the disagreement was settled when the restaurant said the bill was a mistake and, to appease Labit, the meal was complimentary. Labit said he insisted on paying but was told not to come back. He complained that when seafood on the buffet line runs out, the restaurant only grudgingly cooks more. Campo said the proprietress tries to reduce waste of quality food.

I've been to buffets where they dont bring f*** all out to replace what you've eaten until you're gone. Fortunately places like that usually have crappy tasting food that you wouldn't want any more of.

Jeez fatties. How can these people be eating everything (literally in this case) on the buffet THREE TIMES A WEEK? And it's not even that they can say they are good customers, cuz they eat more food than the place is profiting off of on them. I see an early death by cardiac arrest in these guy's futures.

277 pounds =/= fat??? M'kay...
Anyway, if the two guys ate like pigs, taking advantage of the "buffet" rule, they fully deserve the overcharge.
I can go to a bar where they also have the appetizers buffet, and eat dinner with a 5$ drink, but it's quite dishonest... Where's the dignity?

A restaurant DOES retain the right still to refuse service to anyone, I believe, though I'm not sure if it pertains here, as he had already paid.

265 pounds is not necessarily fat. I'm not saying that he is or isn't, I haven't seen a picture of him or anything, not to mention it's not really the relevant issue IMO.
Also, the story doesn't mention if it was All You Can Eat or anything like that. Some restaraunts limit trips to the buffet, etc.

For all of those people saying he should sue (and win) why? They were causing this restaurant to lose money stuffing their faces three times a week. And the owners have every (legal) right to refuse someone their services.

This guy overstepped the boundries of what is considered polite and appropriate behaviour in a restaurant. He was greedy, stuffing his face on only the stuff that costs the place the most money, and eating more than is appropriate. Those are the same kind of gluttons that take all the free samples, tons of free mints at eateries, waiting rooms etc.

I'm in pretty decent shape and I take all the free samples, the free mints et al.

Many buffets I have been too post a notice that eating excessive amounts of food, or taking food and not eating it will result in extra charges. If the owners of this buffet had one of these notices posted then they are in the clear.
