That's not true though. As I mentioned above, my friend got a DUI after one beer. She was informed that you don't need a BAC of .08 (or whatever the limit is) to be considered under the influence, nor do you need to be "impaired" in an outwardly fashion. If you admit to having a drink when a cop pulls you cover, you have driving under the influence whether you are driving in a straight line or swerving all over the place. It is really up to the police officer who pulls you over. I have even heard of a case where someone got a DUI while not even driving (he owned the car but his drunk friend was driving so the owner of the car got a DUI without even being behind the wheel). Than your friend was screwed because that is not the law. The law is impaired or over a certain limit. That is why we have so many tests we run. Maybe she was. According to her, she was informed that a police officer can arrest you for a DUI if 1) you admit to have been drinking and/or 2) the officer interprets you to be impaired. In other words, if the officer actually arrests you, then your BAC reading can be .01 and you could still get a DUI if the officer can prove you were visually impaired. At the end of the day, it is the cop's word against yours. Like I said, this probably varies from state to state, and police officer to police officer. That is why I am a little more hesitant to mock people for DUI convictions because I have seen justice act completely illogical before. In Kurt's case it may not be true, but I see this all the time with people looking down on others for DUI convictions.

There is a gray area with DUI, but definitely not with a DWI charge.

I was always confused with DUI and DWI as well. I always thought DWI was driving without insurance, and DUI was driving under the influence, which could mean all sorts of things, from alcohol to something else in the case of Matt Hardy.
You don't need to know the guy personally to call him a dumbass for getting a DUI.
Anyway, I know the first DUI incident was thrown out, which was fine and that was a few years ago. However, this was the second time this year he had this, and I am interested to see the outcome of this. I think TNA needs to cut their ties with him after Bound for Glory maybe. That company needs some image help.

I think Kurt would be best served with some time out of the spotlight. He needs to take a couple months break, get himself straightened out, & come back fresh next year. It's like he's on a road(no pun intended) to self-destruction & he can't stop himself.

Three DUI (One dropped, one convicted and the current) and the situation with Rhaka Khan (all charges dropped) so 4 that I know of.

Angle better take it easy because he is damn close to having his license suspended for 10 years (which I believe happens after your 2nd or 3rd offense....at least in my area).

They're the same thing, different states use different terminology....all proscribe being under the influence of alcohol or other substances while under actual physical control of a vehicle (including being in the driving seat with the key in the ignition.)

A lot of people claim they got DUIs after having "one beer" - they're liars.
Police departments process DUIs like clockwork, it's like a factory. The machines are calibrated, there's an exact process that needs to go down - officers can go through dozens of these a night.
If there's no evidence of drug use, you must be released if you blow under a .08. If there's evidence of drug use, they can take urine, or bring in a drug DUI officer - who can evaluate you, check physical signs, etc....those are MUCH more complicated cases to prosecute because there's no set level where you're "impaired". But if it's just alcohol, and you're under .08, you are not driving illegally. Even with drugs, they still need probable cause to charge you, and the charge needs to go through an independent judge before it even gets to a jury (where of course, the standard of proof is much higher - beyond a reasonable doubt).
You also must, obviously, be in actual physical control of the car. If someone else drives your car drunk, you're not guilty of DUI. BUT, if you're drunk and have your car on (for example, if it's cold out, and you want to sleep it off), then you ARE in actual physical control of the vehicle, and can be charged with DUI.
There are some variances from state to state, but that's mostly just in terminology. (Some states use "Driving Under the Influence" others use "Driving While Intoxicated" - it's the same thing).
(My experience in this comes from the prosecution end).

I don't see how anyone can defend this. This is literally THE SIMPLEST thing in the world to do. Have you been drinking? Don't drive. THAT SIMPLE. Come on, he's Kurt Angle, are you telling me he can't afford a cab?
The bottom line is, this is the act of a moron. And given how much clout he's managed to work up, TNA won't do anything about this, either.

He got busted on I-66? He must've been tanked to even get on that road, there are always cops observing.
Kurt seems to be an alcoholic, if you're going to go that route don't drive. What will it take for him to understand that? An accident where someone (possibly himself) is seriously injured or worse?
It's not worth it dumbass.
