Okay, so the thread hasn't collapsed yet into ignorant claims about Texans. I think this is a new record, guys. As for this guy, unless there is a hell of a lot to this story we don't know about, I am hoping this guy gets the book thrown at him. Do I win? ..or lose? ;D

If he was afraid for his life, couldn't he have just gone home? Oh, please. Next you're gonna suggest he just call the cops about the noise from his house instead of their driveway! From my point of view, it sounds like he clearly baited someone into a shooting and is using the giant loophole that exists in this stupid law to try and get away with murder. That said, he'll probably be acquitted and have a reality show called "Turn It Down with f*** McAsshole" by the end of the year.

Man shoots music man
....wat.
To whoever it was that said it reeks of "IT'S COMING RIGHT FOR US!" hit the nail on the head.

It's not really a loophole, he still has prove he was in actual fear or danger and given they are at trial that means no one so far has bought it. If the police or DA bought the self defense argument, he would not be at trial having to defend himself again.

Anyone else wondering why it has taken 2 years for this to come out? The Trayvon Martin case put Stand Your Ground laws under greater scrutiny, since it was more polarizing as a young, black kid was the one killed.

This better not stand. After spending about 10 minutes researching online this is a definitive thing that I found that is not in his favor:
Senate Bill 378, made effective September 1, 2007, also "abolishes the duty to retreat if the defendant can show he: (1) had a right to be present at the location where deadly force was used; (2) did not provoke the person against whom deadly force was used; and (3) was not engaged in criminal activity at the time deadly force was used
Point number one does not work in his favor because he was effectively trespassing on his neighbor's property (I think it safe to say that even Texans would not welcome someone who comes on their property to threaten them with a gun).
Point number two does not work in his favor as he obviously provoked the unarmed man who he shot.
Hell, point number three might not work in his favor as well as I am pretty sure that threatening to shoot and kill an unarmed man violates the law. I know that here in Indiana that would get you thrown in jail and Texas cannot be that backwards.
Point of the fact is that if one of the party goers had shot him dead for waving a gun around threateningly on their property the Castle Doctrine would have absolved them of any charges. This defense is utter B.S. F*** that guy.

Yeah, I made that post before watching the actual video and was basing my statement on the fact that the dead guy died in his own driveway. Fine, maybe point 1 does work in his favor, but after seeing that video I cannot think that it was anything but premeditation on his part. Point 2 still works against him. Here's the thing for me. I don't disagree with the Castle Doctrine when it applies to your own property. It is the concealed weapons license that allows deadly force to be applied anywhere. That is just asinine. Because of that you have instances like this where someone clearly provoked a fight, brandished a weapon, and shot 3 men because he was angry. I do have to wonder where the cops were if this asshole had actually called the cops about the noise several times. If anyone should have been confronting the party people it should have been them. Is there any proof that he had actually given the cops enough time to get there from when he first called them?
