Varies from Toon to Toon, really.
For example, in their first appearance, Tom was just abusing him for seemingly no reason. So when he got a chance for payback, then it was deserved.
Other times, when Tom is doing nothing to warrent it, Jerry's a jack-ass.

Depends on the cartoon.
In most cartoons, Tom's the bad guy. In some, Jerry's the bad guy. And in others, there's a third guy bad enough that both Tom and Jerry are the good guys. And in others more, one is bad but then feels guilty about it, and becomes a good guy in the end.
That's what I always liked about Tom and Jerry. Unlike stuff like Coyote/Roadrunner, which only ends one way, T&J would switch it up enough that you could never be 100% sure what was going to happen in the end.

It's within every cat's nature to mess with a mouse, not the other way around. So when Tom is lying around relaxing and minding his own business, and Jerry comes in to ruin his day, or when he's just trying to get some tail from a female feline, and Jerry goes into super cockblock mode, he's the heel.

So when Tom is lying around relaxing and minding his own business, and Jerry comes in to ruin his day, or when he's just trying to get some tail from a female feline, and Jerry goes into super cockblock mode, he's the heel. Prick. Hey, Jerry's a player, he can't help it. Especially given quite a few times at the end of such shorts, he and the female feline become an item. Jerry dreams of large women. ^_- |

There's been many atime where Tom's just been minding his own business and Jerry's attacks have been completely unprovoked. Can be a complete little douchebag sometimes. I remember one time him and another Mouse friend made Tom shoot himself when all he was trying to do was sleep  |

Didn't he once cause Tom to lose him inheritance by constantly provoking him?
Tom was a bit of a dick at times, but he was at least just doing his job and trying to rid the house of the rodent.

Jerry comes into the someone's house, steals their food and makes holes in the walls...
He's a complete villain. If anyone saw a mouse in their house, they'd try to get rid of it too. Tom is just trying to do his job.
