Our pal Madison Carter recently posted a video of Max Moon vs. Nailz from an indy promotion in the summer of 1993. Long after both men had left the WWF. Yet there they were........in the same outfits.
And this happened quite a lot. Sometimes it was something major (used to see legit Doink the Clown outfits used in the indies) and other times a bit less (like Tito Santana wearing the El Matador tights, but not the coat). I'd seen a lot of this over the years and there's literally so many I've forgotten most of 'em.
How did wrestlers manage to keep the outfits? I can kinda get the regular looking tights just getting reused by wrestlers over the years elsewhere, but how did a Max Moon outfit get away from the WWF? Was there some agreement with certain wrestlers over the years so they could keep them? Did they stay way under the WWF/E radar in using them? Did they just never return that ring gear upon their release?

Max Moon is a strange one because they put so much effort and money into the costume but also because the indy Max Moon I mentioned is not Paul Diamond. If you google image Demoltion Ax Max Moon a pic of the Fake Max Moon comes up though it doesn't bring up the photo of Max and Ax I saw from years ago. So I have to wonder if Diamond sold the costume or if he gave it to a friend of his. And as you ask, how did the costume get away from WWF. I guess they just didn't care after Konnan left them high and dry and the gimmick failed.
As for some guys, WWF probably just doesn't care. If it's a guy like Tito who was loyal for many years and really not helping a rival promotion make money, WWF probably doesn't care. I would guess most, if not all, former WWF/WCW wrestlers have their old outfits on indy shows. Most guys probably don't get new outfits to wear on indy shows.

I think in some cases the WWF straight-up gave permission for guys to use various gimmicks, with obvious restrictions on television, videotape, etc.
I'm not doubting that there wasn't another Max Moon running around on indies, but the guy in that Nailz-Moon video definitely appears to be Diamond.
Also, keep in mind that at least back then and maybe now as well, guys were responsible for their own ring gear. So if they bought it, they probably got to keep it.

They kept the outfits because the wrestlers paid for the outfits / gear themselves and still do.
Ray Traylor showed up in WCW as The Boss in his WWF Big Boss Man gear (with the name tag taken off).

Generally, yes, but that was definitely not the case with Max Moon, at least in terms of paying for it. WWF paid for the (extremely expensive) suit which is a big part of the reason they shoved Paul Diamond in it; they had invested so much in the suit already, and it fit him. Now, they may have never gotten it back when the whole thing flopped, however.

Didn't Ricky Steamboat use his WWF gear in his WCW run, too?
And with WCW's low production values, it made it seem second rate. Was odd.

Curt Hennig literally just wore his Mr Perfect gear in WCW. He didn't even switch to black and white when he was in the NWO.

Max Moon is a strange one because they put so much effort and money into the costume but also because the indy Max Moon I mentioned is not Paul Diamond. If you google image Demoltion Ax Max Moon a pic of the Fake Max Moon comes up though it doesn't bring up the photo of Max and Ax I saw from years ago. So I have to wonder if Diamond sold the costume or if he gave it to a friend of his. This is Paul Diamond at a convention in recent years. He still has the outfit. He's out of shape (he's not getting younger, it happens).

Yep, the spandex wrestling gear wasn't the expensive thing. He doesn't have the expensive entrance outfit.

Nailz wore his jump suit post WWE everywhere he wrestled, even in WCW.
Billy Gunn wrestled else where using the kiss lip NAO Attires. So did Roaddog in his non WWE events.

My experience watching Konnan was his stint(s) in WCW during the attitude era, and his appearances always left me wondering why he was a big deal in Mexico...slow, boring, and his promos were always the same, damn, boring thing about salads and potatoes to the point that I was wondering if he was vegan.

It really depends on the individual situation as far as where stuff ends up. Many people have paid for their own gear and end up keeping it. Sometimes they didn’t and they have to return it. Sometimes a talent just stops getting used and they never bring them back or even ask for the gear. They’re just forgotten about.
WWF has been known to lose track of items on occasion. Bruce Prichard told the story of them freaking out about the million dollar belt going missing. I know Demolition Ax sold off his authentic WWF tag team title years ago. I asked him how he got to keep it. He told me that he just asked for it and they let him have it. I have no doubt that they had a replacement ready at the time which made that possible.
I ran into Justin Credible all decked out in his classic Aldo Montoya gear at a convention. I told him I thought he would’ve thrown it out. He said he did and that a fan made the outfit for him. That may have been the case with Paul Diamond’s Max Moon outfit too. Some conventions have provided wrestlers with faithful reproductions of one of their old school outfits so they can advertise them as being in gimmick just for that appearance.
