Dad should have said "Sometimes things aren't what you think they will be. Here's why it is the way it is. I'm sorry you're disappointed. Maybe we can return it, but if we can't; I hope you still enjoy the game".
The only real winners here were the lawyers.

I got that MLB game for Christmas one year, it was pretty bad. The physics were so slow that a routine grounder to third made it impossible to throw the ball to first for the out.

Months worth of chore money down the god damn drain on that steaming pile. It was so bad I cried after playing it for 20 minutes.

Pffftt... money hungry lawyer dad They asked for the game to get less deceptive packaging, existing legal fees, and a $40 refund. Nintendo probably spent more defending themselves than they would have just honoring those requests.

Nintendo probably spent more defending themselves than they would have just honoring those requests. It could also set a really bad legal precedence. Doubley so since Nintendo is not responsible for the Packaging since it wasn't a Nintendo Game.

It wasn't Nintendo's product to recall or change, it wasn't Nintendo's fault they chose to sue and it wasn't Nintendo's fault the store they bought it from had that return policy. Nintendo owed them nothing and had to defend themselves to prevent a bad precedent being set and opening the floodgates for a million other nuisance suits. Had they caved, or lost somehow, the dad's profile would have been raised significantly, he'd have a nice selling point for his lawfirm he could use for years to come.
