The dealership didn't have any reason not to take her money, and they can't control what she does with the car once she's off the lot.

Apparently the ID that she showed them said “for identification purposes only”. I’m not sure of the law regarding selling a car to someone but I’d imagine that it would have to be a valid drivers license and not just an ID card. If she drove the car off site then that’s illegal as well.

And that's why I should've read the actual court filing portions of the article the first time around.  Writer kinda buried the lede.

Tammy "Sunny" Sytch's latest pre-trial hearing in Florida has been officially pushed back to 4/13 at Sytch's attorney's request. The hearing had been slated for this morning.

Sytch, 50, has been charged one count of DUI causing death (DUI Manslaughter, a felony in the third degree), one count of causing death while operating a vehicle with a suspended or revoked driver’s license (a felony in the third degree), four counts of DUI causing injury to a person, and three counts of DUI causing damage to property following the March 2022 death of 75-year old Julian Lasseter during a traffic incident in Ormond Beach, Florida.

Back in August 2022, Sytch waived her right to a speedy trial "arising out of the criminal episode made the subject of this prosecution; specifically, the right to be tried within 175 days of her being taken into custody as provided by law and Rule 3.191, Florida Rules of Criminal Procedure." At the time, Sytch was given "criminal indigent status", meaning that since she is without sufficient income to afford a lawyer for defense in her criminal case.

On 3/3, the Court issued an order for Sytch to submit to a DNA swab of her cheek.

There are several witnesses still scheduled to be deposed, which is part of the reason for the delay.

A civil lawsuit brought by Lasseter's daughter is still making its way to the court. Sytch's fiance James Pente filed a motion to be dismissed from the lawsuit as a defendant on 2/13, arguing that since it has come out that the car Sytch was driving was not owned by him - but by newly added defendant Ultimate Motor Cars LLC out of Florida - that he should not be held liable for "alleged negligent entrustment of the subject vehicle." The original belief when the lawsuit was first filed was that Pente owned the car, which apparently arose from Sytch's arrest report, which listed him as the owner of the vehicle. How that connection (or error) was made, if the car wasn't his, remains to be explained. It seems pretty clear that if Pente didn't have actual ownership of the car, he can't be held responsible for allowing Sytch to get behind the wheel, because he was never in control of that car. The obvious next question is how the dealership let Sytch leave with the car when she didn't have an actual driver's license at the time she took possession of the vehicle. The court has yet to rule on the dismissal motion.

A new report has an update on Tammy Sytch’s legal situation following a pre-trial hearing on the charges of DUI manslaughter and more against her. PWinsider reports that Sytch had the hearing today on the charges. According to the report, the court issued an order for Sytch to submit a DNA swab of her cheek on March 3rd and her next court date is set for August 16th. That hearing will be a reading of the docket and will require Sytch to inform the court whether she’s ready to go to trial, and if she would like to attempt to enter a plea deal.

Sytch is facing one count of DUI manslaughter (a third degree felony), one count of causing death while operating a vehicle with a suspended or revoked driver’s license (a third degree felony), four counts of DUI causing injury to a person, and three counts of DUI causing damage to property. These stem from a traffic collision last year that caused the death of 75-year old Julian Lasseter in Ormond Beach.

The report also notes that there are several witnesses set to be deposed next month and the court is set to make a decision soon on whether they will allow video testimony.

In addition to the previously-reported civil suit filed by Lasseter’s daughter, PWInsider reports that there is apparently another lawsuit filed against Sytch related to the accident, which is said to have been brought by another party who was injured. Details on that suit aren’t yet known.

DETAILS ON LATEST LAWSUIT FILED AGAINST TAMMY SYTCH

As previously noted in other Tammy Sytch legal coverage, a second civil lawsuit was filed against Sytch in regard to the car accident that caused the passing of Julian Lasseter. On 3/21, Jana Olivova, a passenger in another car that was impacted during the incident, filed a civil lawsuot against Sytch seeking in excess of $50,000.

In the lawsuit, Olivova is alleging, "As a direct and proximate result of the negligence of Defendant, TAMARA SYTCH, Plaint iff, JANA OLIVOVA, suffered bodily injury including a permanent injury to the body as a whole, pain and suffering of both a physical and mental nature, disability, physical impairment, disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, aggravation of an existing condition, expense of hospitalization, medical and nursing care and treatment, loss of earnings, loss of ability to earn money and loss of ability to lead and enjoy a normal life. The losses are either permanent or continuing and Plaintiff will suffer the losses in the future. Plaintiff, JANA OLIVOVA also suffered other damages, including, but not limited to, loss of the use of the subject vehicle, damage to the subj ect vehicle. Plaintiff, JANA OLIVOVA, will suffer or incur the injuries, expenses and impairment in the future."

Beyond Sytch, Olivova is also suing Sytch's fiance James Pente, alleging he was the owner of the vehicle Sytch was operating. The police report from the incident listed that as the case, but another civil lawsuit brought by the Lasseter estate uncovered that Pente (who claimed all along he did not own the car) was still technically owned by the dealership Sytch had acquired the car from even though she did not have a valid driver's license at the time. One would think that if and when Olivova's attorneys discover the same, they will file an amended pleading.

Olivova is also suing Geico as the lawsuit alleges both Sytch and Pente were uninsured at the time of the incident. It would appear that would be her own insurance.

None of the defendants have responded to the lawsuit as of this writing and there is no court record that indicates they have even been served.

Sytch is scheduled to stand trial on criminal charges sometime this fall. The civil lawsuit brought on by The Lasseter estate is still making its way through the court system.
