You can't sue anyone over a live crowd deciding to shit on you completely of their own volition. You'd be laughed out of court if you tried. People also seem to ignore that he tried to leverage them out of their place at Tony's side so he could insert himself instead.

This was a public event and you can't be held legally liable for just like, filming a public event and the comments of those people. But also, BTE at its core is a travelogue and has always shown portions of the performances of its main stars and that's included crowd reactions. This was a notable crowd reaction during their performance. Do they absolutely agree with and appreciate the chants? I believe so. I think just about anyone would. But to litigate that would be a mountainous effort and rife with alternate explanations and reasonings for why it should be presented regardless of any agreement they might have. And like, how do you differentiate Cutler recording it and using it on a webshow show from any of dozens of cell phone recordings I'm sure people had, let alone the international PPV broadcast? How does The Elite publishing a recording of this thing that they witnessed harm Punk, let alone harm Punk in ways different from when everyone saw it live? This would be a massive waste of money.

The crowd is chanting "f*** CM Punk!" while Omega and Pac are in the ring. Nick and Matt turn around, obviously acknowledge it, camera cuts away, when it cuts back, Matt Jackson is making some kind of humping motion or pointing at his dick. They also make sure to highlight the chant in BTE this week. If you haven't seen it, there's a song playing during the match highlights, the song stops, and they get a nice clip/shot of the chant. I tend to agree with the belief that it's not a great look to have the EVP's of your company do that. No, they didn't tell the crowd to chant it and I truly couldn't care less what they chant. They can chant the lyrics to "f*** the World" by ICP for all I care, but I do agree that it's a bad look to have EVP's out there doing that. And I hate that I had to go through this shit like the f***ing Zapruder film, but for whatever reason, the AEW fan base is quickly becoming toxic and will immediately light into anyone who doesn't praise The Elite, so I wanted to make damn sure I was accurate in what I described. It's become almost political, where you have to take a side, then you must swear to shit on anyone not on your side. The problem with that is that (to me, at least) it's becoming apparent that all parties involved f***ed up (some more than others). As I said in another thread, CM Punk was an absolutely disrespectful dick for the way he acted at that press conference. However, Matt and Nick aren't exactly proving him wrong with his portrait of them during that press conference. Punk made jokes about not being in locker rooms during his MMA commentary. The Elite showed the f*** CM Punk chants during BTE. Seems to me like both sides are having as much fun with this shit as they can, considering the probably long list of things they can't talk about. Maybe we should get back to doing that, too?
