I heard that one of the games hosted by the site had set up a patreon, so they were probably justified. Could have just taken the one game down though and not the whole site.

Nintendo being douches yet again. Don’t they stay doing this?? I read a piece a while back explaining that because of how copyright works (specifically, if you're aware of an infringement but don't act on it, that can be used to refute future complaints you make) Nintendo feels they have to step in as often as they do. I'm not a lawyer though so I have no idea.

Think about it this way. You create CapeDude. Get a comic out of it,a cartoon and a video game.
Now some fan is trying to use your work. Even if not making a profit it isn't legal.
Just like at least in the US if it is a public place and there is no signs about filming whatever you film you own.

I'm not a lawyer though so I have no idea. That is part of it, along with Pokemon not being something Nintendo owns outright. They and the Pokemon Company have to act in concert about these things, and supposedly, the latter is even more vigilant and protective.

Yeah like The countless Link to the Past Randomizers, including the Super Metroid/Link to the Past randomizer. Someone did an interview with the Pokémon Company's IP lawyer and he pretty much said that anything like that that gets a lot of noise from gaming sites like Kotaku or Polygon is like free research for someone like him. They track all the major game sites and blogs for stuff like this. While they won't send out the C&D notice immediately after learning about it, they start monitoring these projects. Once it looks like they're trying to make money off of it, then boom.
