I had one of those peel off tickets from the Transformers promotion for a free Croissan'wich. I used it the other day. I got there so early that the inisde was still locked but the drive-thru was open. So I told her that I had the winning thing and she said "that'll be 17 cents."
I thought I misheard her, when I got to the window she said it again. "I know it sounds stupid but we charge a tax on free items." The only thing I could wonder is 1) Where did they get 17 cents from? and 2) How were they taxing me on $0.00?
Now here's the part of the story where I'm going to sound insane but I was heading out to Warped Tour that day and since the prizes said "only one per visit" I decided to go to the one by my house, get a free sandwich, head back home, make sure I had everything I needed, and then head to the BK closer to the venue to get my 2nd sandwich. I used it there and got charged nothing.
So what's the deal?

..yeah, that doesn't make sense. Maybe the one that didn't charge you anything was just more lenient or something.

I forgot to add that I actually went inside the 2nd BK, which I wanted to do at the first one just because I hate informing them over the box that I'm using coupons or redeeming a prize. I wondered if there was some Drive-Thru convenience charge too lol

Eh, your state probably treats free coupons as someone else paying the tab for the item, and charges the requisite amount of tax. It's silly, but it's the government.

Human error, on either case.
Either somebody didn't enter the ticket properly and ended up charging you for the tax of the full sandwich, or somebody forgot to ring it up and you got it for free.
No big deal, really.

Explain why I got the 2nd one for free in the same county then. A lot of times it's the computer. When I worked at Domino's, a lot of free offers would ring up as actually totaling 10 or 15 cents due to them having been put in the system incorrectly.

I won free hashbrowns on a peel-off at Dunkin Donuts and didn't get charged any tax. She didn't even ring them up. I handed her the ticket, she handed me the food, end of story.

I dunno about BK since we haven't had one here for awhile now, but I know the McDonalds here charges for any order that isn't a sit-down order. Carryout and drive-thru both cost extra.
And yes, depending on territory they do tax you on a free item. We do that at the grocery store I work at. Someone brings in a coupon for a free item and buys just that and we still tax. For some people we have a "tax exempt" account we just punch it into if they throw too much of a fit. We get some pissed off folks but thats the way it's always been. I think it's bullcrap too, but thats what we do.
As far as the second order...I dunno. Sounds like they screwed it up, or as I said before they just tax on drive-thru and carryout items.

Reminds me of what the local Burger King did in college.
They were running a deal where you buy a Whopper, you get free Fries.
Well, you paid for the Whopper, and got free fries. No tax, no nothing. Just a little thing on the Recite that said $0.00 Med Fries.
Then right when that was done, they started another Promo that was Buy a Whopper and get free Onion Rings. Well, the Free Onion Rings said $0.00 Med OnRing but they had a 0.09 Tax under it.
Never did figure that out.

That's so lame. I think it was just a data entry error myself. Everything's a scam. Remember when dollar menu items at fast food places were actually one dollar? Remember when 16 oz. pops came with the free pop cap as opposed to the buy one get one free cap? Remember when pizza delivery drivers had to earn their tip by arriving at your house in a timely fashion with a satisfactory product?
It reminds me of that Todd Barry joke where he's talking about buying concert tickets. It was something like:
Ticket Guy: The ones we have are $60 and the seats are behind the stage. Todd: I guess I'll just stay home. TG: Stay home? $10.

The first one either lied to you or didn't know what she was talking about. It may have been something her manager forces her to do as well, as there was a Burger King around here that got caught over charging people by 1 or 2 cents on each transaction in an effort to make tax free income.
Our sales tax is 7%, so 7 cents to the dollar, and if you bought a $1.00 item they would tell you your total was $1.08 or $1.09 "because that's how the computer does it".
The only times they are supposed to charge you tax on things is when a coupon is based on the price AFTER ringing it up. Like a gift card for instance.

Umm...my guess is in some odd timing induced moment of restraunt zen, maybe just maybe a guy in the kitchen was gojng to the store for smokes or something and it was gonna be communal stash. So everybody puts in and they know that the smokes or whatever cost exactly $5.17 at the Kum and go. So everybody chips in but nobody has change. You just happen to join the conversation over the drive-in headset at the right time and biggiddybam!$.17 later they have a pack of Marlboros and you are light a dime a nickle and two pennies

Probably depends on state. For instance, if Coke ran a free promotion here, where say you look under the cap and won a free Coke, you still have to pay the deposit and recycle fee and such. So while the Coke itself is technically free, you still pay the taxes, though not the GST on it. It explains it all in the contest rules.
Whip out a microscope and read them on the BK deal and see what it says.
Also could be a data error entry, had it happen tons of times when I worked retail, but it was an easy enough fix, if you had an override number like I did. I could make stuff cost whatever I wanted it to cost, but they checked the overrides, so they'd know if I was pulling a scam or not.
