She ain't coming back. She's got a lawsuit against WWE because they fired her for, get this, the offense of getting pregnant.
I doubt she'd want a job under WWE ever again.

Of sourse there was the fact the WWF was doing nothing with her before she got pregnant and she had a very negative backstage reputation including starting shit with Francine at the first One Night Stand. She would have been rehired for new ECW probably despite this, but due to her frivolous lawsuit she will not win she got herself blackballed.

Frivolous?
They discriminated against her because she got pregnant! She has every right to be pissed and to sue!

I don't think getting fired because you got pregnant is a frivolous lawsuit. It wasn't just because she started things with Francine, the problems they have go back a while and who can say who started what. They weren't doing anything with Dawn Marie, she was promised not to be let go when she got pregnant, and, well, she was. Simple as that.

Frivolous? They discriminated against her because she got pregnant! She has every right to be pissed and to sue! That is her story and she can try to prove it in court. Not likely since wrestlers are independent contractors and their contracts can be terminated without cause at any time (McMahon can even fire wrestlers injured while working for him, yet he usually does not). McMahon is well respected in the wrestling industry for taking care of talent (even talent who never worked for him) with medical conditions and injuries, so she is going to have a tough time proving McMahon did not wat to pay her to stay home for the last 4 months of her pregnancy (especially since he did pay out her 90 day no compete clause and I believe a little extra on top of that). The locker room was reported not to be sad at seeing Dawn Marie go and she had not been used and was not going to be used in the immediate future so it was a prudent business decision. In general suing a promoter is never a good decision in wrestling. Most promoters will not want to deal with a talent that does that. McMahon may give Dawn Marie nuissance value to go away, but I am sure McMahon would not have let her go if he thought she was going to beat him in court. I am no McMahon lover, but from what I know of the situation I am willing to support him on this one.

I saw a picture of her from Hardcore Home Coming, and she looked pretty heavy. Then again, she was a couple of months pregnant. I haven't seen any recent pics though.

There's also the issue of the alleged fathership of her child, and the fact that it might be uncomfortable for both of them to be in ECW together.

well why keep her around if she is pregnant. 1.its about sex appeal and most guys don't find pregnant girls that attractive. 2. She will have to take time off for maternity leave anyway so she wouldn't even be around but she would still be getting a paycheck? 3. wrestling is an extremely dangerous sport to be pregnant and participate in.

Word around the internets say that TNA is interested in her when she feels like returning to the business.

By that logic, Droz should be dropped off the payroll because he's crippled. Hey, he's useless! Why not fire him? Because, deep down somewhere, VInce McMahon has some sense of decency. It's sad and maddening that he can't extend it to a pregnant woman. Like it would put a dent in his wallet to pay someone who has to go off-screen. He only rakes in 47mil a year after all. And that's only off of stocks. Imagine how much it is with his paycheck added in.

If you are unable to perform your job by something that happened through your own choice why should you continue to be paid?

And that's only off of stocks. Imagine how much it is with his paycheck added in. Your Droz fact completely negates your entire Dawn Marie argument. McMahon has no legal or even moral obligation at this point to continue to pay Droz, which he does and has done for 8 years. Watch Beyond The Mat Special Edition with the Foley, Funk, and Ventura alternate commentary. None of them were WWF contracted employees when they did the commentary and they all go nuts explaining how McMahon takes care of wrestlers and their families even when the wrestlers never worked for him. Unpaid maternity leave is a legal right granted in most states to permanent, full time, employees if they wish it. It is not a government imposed right to independent contractors, which wrestlers are, and paid maternity leave is not mandated to anyone in any state. Dawn Marie can talk about promises all she wants, but if she does not have a signed piece of paper amending her independent contract, her oral talents and agreements will mean crap in court. Not to mention, McMahon paid he during her first several months of pregnancy and then paid her for several more months after her termination, so she can show no damages because he did not owe her a penny under her contract. I thought Dawn Marie was okay in a skanky hot kind of way. I really do not miss her. From the rumors most of the guys in the locker room miss her when Lita is not around to lend a hand so to speak. Her lawsuit does not have legal merit and if I was the judge it would be dismissed and she would have to pay court costs.

If you are unable to perform your job by something that happened through your own choice why should you continue to be paid? because she was pregnant and in most states in the US it is illegal to fire someone for being pregnant, which is what Vince did and as for her bad attitude backstage that was just at ons, on smackdown she was seen as a friend/sister to the other divas.
