Phil Harrison told Stephen Totilo of Kotaku that if it was a new game that was being played, it would cost a new game price, suggesting that the fee scales to the game's MSRP.
Also, I would like to point out that I just love how Phil Harrison seems to find himself involved with consoles that have horrible public reception from out the gate. He was a prominent guy at Sony in the early years of the PS3, and now he's at MS during the early goings of the Xbox One.

You know, I think we probably should've known something was up when MS had plants in the audience cheering/piped in cheering during the event.
That probably should have sent up warning flags that things weren't on the up and up.

Although, bummer to see that Microsoft has essentially decided to make gaming secondary/thirdary(?) to their "All-in-One" sells point for movies, music, and games.
Edit: Also, I see that Gamertags and Achievement Points are being brought over...does that mean those with Gold accounts can start on Gold with the XBox One? I wouldn't be surprised if not, but it will effect my Gold purchasing with the 360 for now.

God, I used to love going up to Blockbuster Friday evenings as a kid and blowing my allowance on the latest game or a movie I wanted to see. Now the store I frequented is a beauty parlor.
