I still think half of the blame for this situation lays on Cody's shoulders, he let the WWE trademark the name in a way that explicitly states it does not refer to a particular individual, unlike the trademarks for real names or indy names like CM Punk. He left in an amicable way, still working with them to settle legal matters, and coulkd have used that to obtain the rights, but didn't and seemed to be under the impression they wouldn't screw him over when that's what they've done in ever other case. It was naive, but he's learned from that.

Cody could use the name of course before I think, but the problem was that he can’t sell any merchandise with that name on it because WWE owned it.
But now he’s able to do both now, so that’s cool.

Well in all honesty all WWE has to do is use them again on an NXT show, have them on the Network, and they have the Trademark again. When they bought WCW, they bought the right to do that. If they lapse, but they introduce them again, then they get the TM rights back. If there was no Network, WWE never mentions it in the WCW DVD, and doesn't have a special NXT show, then someone else could try to run and trademark those shows. Registration in the end is a technicality, it's about using the term in commerce and customer confusion. I think Cody is smart, and played the long game with it, and got something out of it I also think Cody wanted some ownership of what his Dad created, and what WWE spent a more then a decade trying to destroy.

It's cool that he's got his whole name back but I got another question. Have they ever explained "The American Nightmare"? Like, Dusty embodied "The American Dream", being just some blue-collar slob who busted his ass and made it to the top. But Cody's just this regular dude. Is he saying that nepotism/connections/privilege are the flip-side of The American Dream or was he just like "Well, it sounds cool"?
I'm not trying to rag on Cody, I genuinely am curious about if he ever explained any meaning behind it other than just the "Well, it sounds cool" obvious reason.

So this might be me misremembering some stuff but I THINK he started using it when he debuted in Ring of Honor as pretty much being the “nightmare” of the company going to winning the belt. Never heard a reason, but it wouldn't surprise me if it was to hold onto another piece of the family legacy.
