Yeah when I first heard this, this didn’t fit Cain tho obviously things can change and he was a combat athlete
But yeah If true, he will still be in trouble but the consequences will not be as bad

Knowing these new facts, hopefully the worst Cain gets is 1 years supervision and 20 hours of community service, but I doubt that will be the case :/

I get the sentiment, but "he had it coming" is not a good legal defense. Yeah it is a slippery road He is going to need proof and then they are going to say why didn't he report it. If he did and cops did nothing then you will have the sympathy Any parent will chase down someone who abused their child so he will get sympathy in that regard but it seems like he chased them down as opposed to catching something in the act. Premeditated act and all that will be used against him

If you can showcase pics and proof of the abuse and make it visual for the jurors then you play on that emotion. That is best he can hope for tho. Like I said on the flip side you can call it premeditated and he should have let the authorities handle it. It is going to be logic vs emotion and he has an uphill mountain to climb to dig out this hole

If someone does in fact abuse your kid and you kill them, you certainly are MORALLY right.
Being morally right doesn't allow you to shoot whoever the f*** you want though.

I can sympathize but I certainly can't excuse it. Hunting down someone to murder them isn't at all the right course of action in response to something like this, especially since Cain absolutely has the money and the visibility to put the pressure on the police to pursue the proper legal channels, and while it wouldn't excuse it if he did, the fact that he shot the person who didn't do it doesn't make it any better.
I can see it being a mitigating factor in sentencing but I definitely don't think he should get off for it.

Most places, something like that can turn an attempted first-degree/intentional/premeditated murder into an attempted second degree murder/intentional manslaughter. Depends on the jurisdiction.
Here in Kentucky where I practice, you’d still be looking at a Class B felony and 10-20 years in prison for first degree assault.
Jury nullification is very much a real thing though. You take something like this to trial, a jury may well decide to just let you walk. And there’s no appealing a jury verdict of not guilty. Double jeopardy and all that.

The reason Cain is absolutely f***ed is because, without some pretty damning evidence, there's no justifiable proof for even a "crime of passion"
To put it bluntly, if the laws weren't so cut and dry on this, you could shoot almost anyone and say you did it because they were abusing your child.

If he shot the guy who did that then I can easily understand due to what it is but if you shoot the wrong person, someone who's innocent and had nothing to do with it, yeah. Just, yeah.
