I'll try and have something mildly interesting but not distracting playing on YouTube while I'm working, and lately it's been police body cam videos of DUI stops.
In a lot of cases the suspect completely whiffs the field tests and they go to jail, but there also seem to be more than a few cases where the suspect seems to do fine and the officer is still like "you know what, you smell like booze, you're coming down the the station for a blood test", and in those cases they're usually still over the legal limit as well.
So what I'm asking is, you think there's ever a time when the police pull someone over, give them the field tests, and then are like "you did fine, have a nice night!" and let them go?

Anecdotal, but I did.
Mind you, I wasn't the driver. The driver (who is currently my roommate, but wasn't then) failed, then they tested me and after I passed they told me to drive his car home while they hauled him off to the station.
Unfortunately, nobody ever taught me to drive stick.

I did as well.
I'm not even sure why he tested me. I wasn't weaving. I wasn't speeding at some ridiculous level (85 in a 70 mph area on an empty highway around 3 AM). And I hadn't been drinking, or been around alcohol, so no smell.
But he had me follow the light with my eyes and do a heel to toe walk. Then I was let go with a speeding ticket.

I'm actually shocked I wasn't tested this one time. Me and some buddies were driving home from an MMA tournament and the driver was going wicked fast on the highway. We got pulled over and I was sure they were gonna try to get us on alcohol (nobody was drinking, btw. We just wanted to make good time, since we were driving from Maine to Massachusetts on a Sunday night). The driver reaches into the glove box and pulls out his Constable badge and the officer let us off with a warning.
Also, don't do this. Just because we did it, doesn't mean you should. We were lucky the highway wasn't super busy and the officer pulling us over was in a good mood lol

Years ago, I was pulled over. I had been drinking, but started drinking water and waited a few hours before I went home. They gave me a breathalyzer and I blew a 0.0.

I had one beer before an Iowa Football Game, got pulled aside AFTER the game and asked to do a field sobriety test. I passed easy and then the son of a bitch asked me to do the alphabet backwards. I can't do that anyway. My brain doesn't work like that. Meanwhile there are people puking in the parking lot from doing beer bongs. Oh well, I had zero charges because I did nothing wrong.

I've always thought the "alphabet backwards" thing was a crock of sh**. Like you said, I'd have to really think about it to do it sober. Obviously I know it, but it isn't second nature like saying the alphabet the right way.

2 times now. But both times it was new Years Eve,I reeked of booze and was driving someone home.
First time cop pulled me over for slightly speeding. Told him I hadn;t been drinking was disignated driver and was driving my then girlfriend home. Who was DRUNK in the passenger seat.
He smelt the booze on me,she had spilled a drink on me not long before we got in the car. So he had me walk a line,do the alphabet forwards and backwards.
Ok you are good go on.
Second time was 2 years ago. This time I switched lanes without using my signal and swerved a bit.
Again was designated driver,had had a drink spilled on me earlier and was driving my girlfriend home.
Cop asked me ot get out and once I walked the line backwards annd forwards he let me go.

I did…had a few beers, but I was also eating spicy carne asada tacos that hid the scent of the beer
The officer asked if I had been drinking, I fibbed and said no, and after a second of looking at me, he let me drive off

I actually can do the alphabet backwards in like 3 seconds because I learned it on a long car ride as a kid once. My friend got pulled over and said they asked him to do it backwards…but from like R to F or something. Didn’t even let him start at the beginning. Or…end I guess. I don’t think it would stop me I’d just do the first part silently in my head for a second. But it’s a useless skill if there ever was one.

Not proud of it. But in my dumber days. I once got pulled over at 3:00 am while I was high. I was holding the joint in my clenched fist while talking to the cops. They let me go.

I once drove to a police station completely hammered to pick up a friend who had gotten a DWI. Cop at the desk asked me if I’d been drinking. I told him I had been asleep in a way that sounded annoyed I had to be here. He looked at me and must have decided no one is stupid enough to drive to a police station drunk and we went on our way. Little did he know…I was that stupid.

Other than the GNT (where they track your pupils), it is more about you listening to/following the directions. There are too many varying factors other than intoxication for the reflex tests to show anything. Weather, person's health, clothing, surface, and time of day among other things can all skew the findings.

Indeed, the FSTs are mostly to get reasonable suspicion of DUI, which gets you to be able to do a BAC test on them. And that process is very regimented, having to do constant mouth checks, time everything right, etc. Only a handful of our patrol guys like doing DUIs, for the whole process to just get a misdemeanor charge out of it. The Drug Recognition Experts are interesting to watch, as their process is much more involved, and not just determining THAT the person is under the influence, but WHAT they are under the influence of.

They have a fantastic way of getting around all this here. Go through a checkpoint? They pull you over? Blow. No. I’m totally sober. Lost license and we’re impounding your vehicle and the burden of proof is on you.

My girlfriend did when multiple cop cars at once pulled her over on the way home from work to harrass her about swerving (she wasn’t at all). They got in a bit of trouble over that, and we still don’t know why it happened.
