Since a lot of people seemed to miss this back in the summer...
"Well, speculation about this subject can now end, because Nolan told Empire quite clearly that no, The Joker will not be returning for Batman 3. No reason was given, other than Nolan’s own explanation that, “I just don’t feel comfortable talking about it.”

Im hoping if previous villains are used that Batman pretty much spends night and day hunting them to exhaustion and enter BANE. Kinda like the comic. I was kinda hoping they went with HUSH though. He was cold blooded.

Well, let's look at the state of Gotham City at the end of The Dark Knight:
-The major crime bosses are all dead and the Joker, who seemed to be absorbing their goons, is presumably either locked away or dead (I always assume one of the SWAT team shot him after Batman left)
-The man bent on cleaning up the city, Harvey Dent, is dead. They held a public funeral for him, so at the very least, everyone in Gotham thinks he's dead.
-Batman is apparently a fugitive.
There is a HUGE vacuum for a new crime lord to step into in Gotham City. I'd imagine one of these types from his Rogue's Gallery will be the main villain, with either Catwoman thrown in as a wild card or Bane/Killer Croc as the boss' muscle.

You guys seem to be overlooking two face making a return. I would so mark for that because he's my favorite Batman villain. Kind of bummed out about Riddler, but I wish we'd know for sure who is in this.

I'm gonna go out on a limb and say we get:
Ra's Al Ghul - The main bad guy who is, again, operating from behind the scenes and wont be revealed until the second half of the film.
Scarecrow - Working with Ra's again, and provided with Killer Croc (who isn't really a big Croc man, but is just a big scared man who Scarecrow's fear gas makes look more like Croc).
Penguin - The new crime boss. He isn't DeVito/Burton version and he doesn't use trick umbrellas, he's just a short mob boss with a big nose whose street nickname is Penguin. He operates out of the IceBurg Lounge as a nod to the comics.
Talia - She's Ra's daughter, but Bruce doesn't know this when he meets up with her, heel turns to join her father later, with a possible turn back again to save Batman and defy her father.
It gives us a similar structure to the previous films, brings things from the first film full circle and leaves some big names around for whoever takes over as director when Nolan leaves for Batman 4

Scarecrow.
I'd put money on it.
He's one of the only villians to be in the first two movies.
Nolan likes working with Cillian Murphy.
The metaphorical implications of the Batman doing battle with a guy who uses fear is too much for Nolan to pass up.

That's all well and good, but considering that the Riddler is not only my favorite Batman characters but one of my favorite comic book characters in general, I have to say that I know what I wanted

I feel like he needs some kind of love interest and its going to be Catwoman/Talia and I would like to see Two-Face return but I just dont think so. Thought the Riddler would be cool but I have faith it will be good.

So no Joker, Two-Face, or Riddler? Good. As great and iconic as they are, I like that Nolan is giving lower tier villains more exposure.
I doubt we'll see Croc, even with Scarecrow's fear gas theory, I just have this funny feeling Nolan won't go for it. Bane, on the other hand, I can definitely see happening.
I would love to see Hush, but chances are that isn't happening with Ra's and Scarecrow around.

No Riddler, Joker, Penguin (was outed a couple of time ago) and Catwoman isn't a given. So, I see Black Mask, Deathstrike (as the hired gun of Black Mask) and Catwoman OR Talia Al Ghul.

If thats the case I hope to see Jack's Joker, Michelle Pfiefer's Catwoman, Jim Carrey's Riddler, and Ahnold's Mr. Freeze forming an alliance...

Bu Deathstrike do you mean Deathstroke? If you do, he isn't a Bat rogue as such, so I doubt we'll see him, although he does have links to Talia and the League of Assassins, so it's possible. Deadshot would perhaps be more likely as he was originally a Batman rogue. You are right, however, in that Nolan has publically said No Penguin, but he's also said No Catwoman. As such, from my suggestions about, I swap Penguin for Black Mask.
