I had a feeling Joker was originally suppose to be in the 3rd film and then well Heath Ledger died so it took him years to change his storyline idea.

This worries me. That just sounds like we're going to get some combo of Two-Face/Ra's/Scarecrow (Or if we're going to push it a little, Zsasz) again. If we don't get Riddler, at least do someone new like Ventriloquist or make a proper Bane or ... well anything but Croc.
I hate Croc.

I hope this doesn't just mean that we are going back to Ra's Al Ghul. Unless Joker is recast though, I don't see what else it could mean.
I hope this does mean that Scarecrow gets owned AGAIN, with a line from Bats to the extent of "You just never learn. *ATTACK*"

I think having Scarecrow again is fine, he's been in the other two, so why not. Plus, he gives Nolan his credible non-fantasy Croc as just being a big guy who Batman sees as Killer Croc because of fear gas, if indeed Croc is in.
Ra's will work, but only if they introduce Talia. Just Ra's again, not so much.
More rumours out of the casting camp is that he's interview for a femme fatale, which is highly rumoured to be either Talia or Catwoman, so we shall see.

Any of the previous villains returning is fine by me. Ra's has his seemingly supernatural side and represents where Batman was when he began his mission in Gotham, Scarecrow makes for a fun cameo or more if need be, and the stories of Two-Face and Joker feel like they can be fully fleshed out in a third film.
Dent still symbolizes the fight for Gotham's soul, so him reemerging could be a key plot point, and the vibe I got at the end of Dark Knight was that Joker was not only meant to remain around as Batman's foil, but perhaps even acting as a quasi-Hannibal Lecter figure, an inmate who takes joy in making Batman miserable, yet helping him in some odd way, maybe hoping to get him to eventually see "the funny side of things".
Still, you have to figure there's going to be a new villain to keep things fresh.
