Does that mean any studio can sue porn companies for their porn parodies? Are the makers of 'The Assengers' currently nervous at the moment? Oh please, a porno of The Avengers nowadays wouldn't have that original of a title. Would be just called "The Avengers: A Triple X Parody" or something like that.

No. They are considered parodies and are safe from lawsuits. Asylum has never claimed their films to be parodies. I bet they will now to get out of trouble. Thing is, I don't know if mockbusters would technically violate copyright law either. They're making intentionally similar movies, yes, but if they're not taking footage, using the copyrighted title, or doing anything that is actually copyrighted by the movie company, I don't know if there's anything they can do.

Not true at all. Someone making something that is deliberately ripping off an intellectual property and trying to sell it for profit is still illegal. Why do you think WCW got sued by Marvel over the Arachna-Man gimmick? If things worked the way you're speaking of, I could make a movie called "Bat-Men" about twins whose parents were murdered so they decided to dress in bat costumes and fight crime, and it'd be perfectly legal because "hey, it's sort of different".

Just on a technicality, WCW didn't get sued by Marvel, Marvel threatened to sue. Lawsuits are threatened all the time, even when they don't have merit. Not saying Marvel wouldn't have or would have won, just that actually suing and sending a cease and desist are different things.
And my reasoning for questioning it is that we've been seeing this for a while now, and yet no one in the highly litigious world of entertainment has tried to do anything until this highly mocked movie came along. That makes me think that there's a reason for it. A lot of these mockbusters have absolutely no resemblance in plot to the original unless the original was a public domain story that the major studio can't really claim the rights too. I think that's how they skirt around any copyright laws, make sure the only thing similar is the title and the most bare of summaries.

I think Disney will be gearing its lawyers up for this one, but still....that's pretty great, and as a comic book fan who has always thought some of the female Marvel characters were HOT.......I kinda want to check this out now, and I feel no shame in saying it. Now, as for Asylum....y'know, s***y movies or no, I don't think they deserve to be squashed by a major studio just for making crappy movies. After all, Troma has been putting crappy movies out for years (and this comes from a diehard Troma fan), and I don't see anyone suing them (well, at least recently). So they DARE to piggyback on the majors. I think its pretty darn smart of them. Almost Roger Corman-esque. Screw Universal......they should have known basing a movie off of a F-Ning BOARD GAME was going to be full of fail. And I'm sorry, but it just looks like a collage of recent Sci-Fi/Action movie cliches' all strung together. I mean, what....isn't this like the 10th aliens invade movie made in the last 2-3 YEARS. And giant robots.....I mean, Transformers anyone? And as for the stupid people that would actually mistake the Asylum's product for the real thing (and trust me, I worked at a video store for 2 years.....I saw a LOT of them).....f*** em. If they're too stupid to realize that a major movie that's being advertised for theatrical release would NOT already be at the video store (though, I see that changing eventually). I mean, why would, say, Joss Whedon decide to release the Avengers both at the theaters and on video........most people would skip going to the theaters nowadays, and just rent it and watch it on their nice HD tv's (well, those that own HD tv's.....I still have a big ole clunky one). It'd kill the theater eventually. It makes no sense in the current market. Point is, I don't think the Asylum should be driven out of business for having a smart little business model. I just wish their movies were better.

Asylum films use blatantly misleading materials to promote their films not as parodies but as the real thing. Yes people are stupid for falling for it, and yes the movies being piggybacked are terrible, but it is deliberate.

Asylum is basing their promotional material around films that they do not own.
