Assuming TNA don't fire Kurt, could Matt not sue for unfair dismissal - after all, they've both committed the same offence, so why would Kurt not be fired (all things being equal)? He could but, he'd fail most likely Matt was already suspended for various reasons and Kurt isn't. Plus there is the whole independent contractor issue.

Daniels had gotten a DUI in 2009 and wasn't fired, it's not the like Matt Hardy firing set a new precedent or anything.

Nothing is ever Kurt's fault, it seems that he's always hacked or framed. I'm still waiting for "the real story" to come out concerning the arrest in South Dakota or wherever it was.

If that's the case, there's no such thing as "unfair dismissal". Hell, I'm not even sure if that's a thing anywhere. I've never heard of it and I have taken Employment Law and Human Resource classes. Anyway, the best Matt could hope for is to draw unemployment. And I really don't think that would happen. Besides, the situations were different anyway as Matt was already suspended for being late to shows and bringing bad publicity to the company, the DUI was just the last straw. Kurt's been there longer and while he's had his fair share of trouble too, he's at least been completely professional with the company.

Matt Hardy's DUI came at the end of a laundry list of things, and he was already on thin ice with the company. [/quote] Yea, that was a brain fart on my part. We were talking about wrongful termination and whatnot so I wasn't even considering that none of that even applies to wrestlers in the first place.

PWtorch are reporting that Kurt passed whichever alcohol test he took so he was apparently under the influence of something else. If true, I have a nice big plate of crow for the gun jumpers and a reminder. We went thru this many times before(Rhakah Khan anyone?)let more info come out before u judge or at least say "if guilty" or something like it before u blast him, a hardy brother ect. Why would people eat crow just because he was apparently under the influence of some other substance? Impaired is impaired.

Very doubtful, given his laundry list of injuries he has never properly rehabbed. He's like a jalopy that keeps running because the duct tape hasn't come off yet. When he runs out of juice, he's going to hit the ground badly. I don't look forward to it, but it doesn't mean I will be shocked when it finally happens.

An arrest is a mini investigation. The final result of which happens after a court date or few. My post indicated to the "oh he's guilty" crowd to judge after all the facts are in. I referenced the Rhakah case as one example.
