I suspect this doesn't really go anywhere. If WWE is trying to cut costs and pump profits, which is their primary goal the past few years, you don't do that by incurring legal fees, especially not against someone who isn't afraid to go to court with you. It does make me think of Big Show on Austin's podcast joking that of course he never talked to WWF before his WCW contract expired, as that would be illegal, in a way that made it very clear that 100 percent happened. This probably happened more back when WWF was sloppier about legalities, leading to stuff like the World Wildlife Fund lawsuit, I doubt it happens much these days, but I do think people probably break these rules a fair bit from time to time. Jericho completely illegally met with Vince to negotiate before he jumped to WWE, he goes into great detail about it in his first book. I have no idea what you’re talking about. Jericho was a clear a Mr. Robinson was picked up at the airport.

Well thankfully AEW was able to speak to Jeff for the first time today when his non-compete expired, come to a deal, make merch, film an entrance video, and get the rights to his song. All in one day. Almost as fast as when NBA players sign deals 1 minute after they're allowed to do so in free agency.

Well thankfully AEW was able to speak to Jeff for the first time today when his non-compete expired, come to a deal, make merch, film an entrance video, and get the rights to his song. All in one day. Almost as fast as when NBA players sign deals 1 minute after they're allowed to do so in free agency. reminds me of that time when WWF had Paul Wight come to Toy Fair to get reference shots for his action figure while Wight was still in WCW.

Songs like that still need broadcast licenses to use or an acknowledgement of credit so you still need to purchase the rights to use them which, by all accounts, AEW did with not only that song but Zack Tempest's other works including Hardcore and Crash's theme, which were also used in sports broadcasts and such.

I for one would like to see WWE and Jerry McDivit take on the Khan family at some point.
It would perhaps be a lesson in humility for WWE if a richer organisation can go long in the courtrooms and not run out of money for legal fee which is normally the tactic WWE use for most legal matters.

I for one would like to see WWE and Jerry McDivit take on the Khan family at some point. It would perhaps be a lesson in humility for WWE if a richer organisation can go long in the courtrooms and not run out of money for legal fee which is normally the tactic WWE use for most legal matters. Except it just wouldnt benefit AEW to do that. There is a reason WCW, with Turner behind them and so also much richer, just used to settle. It's easier, it makes it go away and when you're that rich, you dont care. You accept you got caught out and you move on. Especially if you're being challenged on something you dont actually want anyone else (government/politicians/pressure groups etc.) getting wind of you doing and sticking their noses in, because you know you're going to do it again.

I don't think the WWE contracts actually have a non-compete, WWE just has the right to terminate the contract unilaterally on 90-days notice. WWE may have a claim, here, for tampering/tortious interference, if it can credibly establish that AEW was negotiating with Hardy before his contract had lapsed. Evaluating from 10,000 feet, though, the damages would be nominal at best, given that WWE "fired" Jeff Hardy by evoking the 90-day notice provision. Essentially, AEW may be liable for inducing Jeff Hardy to breach a few weeks of his contract. I just don't see WWE ever pushing the issue of an actual non-compete agreement, because that's an absolute minefield when it comes to the classification of wrestlers as "independent contractors." Non-compete agreements are a hallmark of an employer/employee relationship, legally speaking. I agree that I don’t see WWE pushing this issue in this or most other cases for a variety of reasons. If someone showed up on AEW while still under contract with WWE, that would be the kind of thing they’d go after (and rightfully so) … I mean like if Ricochet was in Year 2 of a three-year contract and just bolted to show up unexpectedly on AEW type thing. During the 90-day period, it’s more ‘go work somewhere else and we quit paying you.’ And for most talent who aren’t renewed or cut, they WANT the 90 days of pay. It gives them three months without worrying about paying rent or whatever while they figure out their next steps.
