If his contract states that leaving early means gets no royalties for the footage from the period he worked of the contract he breached, then I don't have much sympathy, he should have consulted with his lawyer before making his walkout permanent... However, if they're now trying to nickel and dime him over the use of his name and likeness on the network and in a videogame released nearly a year after his release then he needs to use legal means to make sure he gets what he's owed. If they feel they can get away with doing this to a star like Punk, lowercard guys are really going to end up feeling the pinch.

I hope Punk loses his case if it goes to court. He deserves to lose. If for nothing else than walking out on a valid contract and dicking them out of money they could have made off him until his contract officially expired this summer.

He had to make someone else send a letter? REALLY? He couldn't go to Titan Towers and face them like a real man? I thought CM Punk was all about respect, speaking his mind and could've went there to cut a new pipebomb promo on Vince and all the other coroporate officers. Just proof that CM Punk is a whimp and a shrimp. He should've met Vince McMahon and resolved this problem FACE TO FACE. But Vince probably would've trapped him and had a bunch of guys hiding at the WWE corporate offices waiting to attack Punk when he came for negotiatcions. That'd not only send him a message but make Punk back off and think twice about messing with WWE again.

Yeah the independent contractor thing confuses me. You're not employees so we don't have to treat you as such, but you can only work for us.
I'm likel just ignorant as to how it works, but that just sounds wrong.

It's not like he left without telling anyone. He told them he was done, he worked all the dates in his contract and didn't want to extend it to do more dates, and it was over. They don't have much of a case. Not sure how royalties, even though 2K15 isn't even out yet, work in this situation though. I seriously doubt that the WWE would have CM Punk sign a contract that ended right before WrestleMania. Contracts don't work like you would expect. There was a post here somewhere paraphrasing Kevin Nash explaining how they worked, I wish I could find it.

You don't know what the status of his contract was. As has been mentioned, if he had worked all his officially contracted dates as per the structure of WWE's contracts, he was within his right to do what he did in that time between January and July when he would be officially free to pursue other ventures. If this was indeed the case (And no lawyer would advise Punk to seek monetary restitution over the use of his likeness and royalties if he himself was indeed in breach; it would be an unwinnable case), he "dicked" no one out of ANY money. Because he simply sat at home and did nothing other than wait. He made his money. Both parties were in stasis until July. He owes WWE nothing in that specific case. As far as royalties goes, that too would also depend on the provisions in Punk's contract. For all we know, when WWE was desperate to re-sign him in 2011, they agreed to certain terms of his choosing, like a very specific pay out for the use of his image and likeness. If structured this way, WWE will end having to pay Punk what he wants because of the contract they too agreed to. Right now, though, it all hinges on how Punk's contract is structured and written. That said, I'm of the opposite mindset. I hope if it goes to court WWE loses. They've f***ed over far too many people over the years with pettiness and the flagrant misuses of supposed independent contractor status. They have it coming.

Both parties are signing a contract with that intent in mind -- to perform solely for WWE during the length of said contract or for the specific dates mutually agreed upon. Where it gets "unlawful" is WWE making demands of their wrestlers not in line with said agreement, or interfering with things outside their range of allowable or enforceable control. For example: They cannot truly legally "fine" you for not wearing a suit in public. WWE makes these demands, and wrestlers comply, because while WWE has no leg to stand on from a legal standpoint with micromanaging OUTSIDE of what happens in their ring or in the arena, they still use the specter of de-push to force their will. This also goes for telling contracted wrestlers they can't drink or party, etc. OUTSIDE their job. They have no right. They also have no legal right to test an injured wrestler, not competing, for pain meds or legally prescribed PEDS if they're not on the clock. They also can't force you to get a haircut, lose weight, etc. or any of the stupid things wrestlers do anyway because of the fear of being released for unrelated reasons or at the very least not pushed. There's tons more. But wrestling gets a pass because people think it's all carny bullshit. The only right WWE actually has is what both parties specifically agree to in the binding contract. That's it.

I seriously doubt that this will ever go to court. They are a publicly traded company that is already reeling from some recent bad news. CM Punk is a much bigger star than Raven (who foresaw that 12 years ago?), so any actual lawsuit between him and the WWE will actually be news that investors might notice. If investors think that a lawsuit might affect the way that WWE handles talent contracts, it might drive stock prices down even further. There is no way the WWE will risk that.
